Hello,

I have received a PCN for parking on concrete spots which I've assumed for years, are used for local resident parking. I've been issued a parking ticket claiming I was parked on the grass verge. There is a small spot along where the parking spot is, that can visibly seen as grass verge with small signage above it, stating no parking on grass verge. But it isn't specific about what is classed as grass verge here. The portion I was parked on, the road has identical spots across multiple different spots along the road which have no restriction signage. These spots are routinely used by residents for parking.

I had responded with an informal appeal regarding the PCN which was refused and I'm still requested to pay up the discounted fee. I've uploaded some photos of the area I was parked on and the "grass verge" spot with signage above it. I've also uploaded the correspondence to my informal dispute. I'm looking to dispute the ticket informally as I can't see how where I was parked, is considered a grass verge, but rather a crisscrossed parking bay as they're in multiple spots across my road with no signage above them. As these spots are located all along the road with no signage on any of them stating that they're grass verges. Also, these spots of been used for years as parking by residents on a consistent, daily basis.

I've misplaced the original PCN slip though the reason given is also on the info screen on the payment website. Which says: "01 Parked in a restricted street during prescribed hours"

I'll attach the photos just below that are also used as evidence by the council.

None of your links worked, so I've posted the CEO photos for you below:

Virtually everything the council says about parking on a verge is irrelevant, the PCN is for parking on a waiting restriction that is in force at all times, and that is indicated by the double yellow lines. For some reason some people think you can get round the yellow lines by parking on the pavement, this is not the case or else we could all park everywhere that double yellow liens can be found by simply parking on the pavement.

Is there any chance you could find the PCN?

Also it's presumably somewhere along here https://goo.gl/maps/siXkaWvMKTsgMYWs6 but please can you post a link to the exact spot?

In the meantime I'll try and get hold of the traffic order.

Nothing much has changed in fifteen years, apart from DYLs on OPs side.

OP, you're leading us astray:

The PCN does not refer to 'grass verge';

Their rejection does, but only because you raised the issue, it then states and re-states that the issue and contravention relate to the DYL.

Pl get away from grass verges, you cannot park where you did because of the DYL.

I cannot see any substantive defence here and the discount expires on 10 August.

Yes, it's possible that the traffic order might be flawed and yes, they might reissue the discount after rejecting formal reps, which themselves might yield substantive procedural grounds.

Perhaps. But what you do know is that the discount expires on 10 Aug.

If you're the registered keeper with current DVLA details then you have to decide whether to carry on.

The only defence I see is Legitimate Expectation.
Google maps seems to show habitual parking in this location dating back to 2016 (a little after DYLs were placed)
Assuming that this is the case and that it is mainly residents and that council have habitually ignored and not put out any warnings
