Southwark Council - Parking Contravention 62c in Elephant Road

Good Afternoon all,

After doing some digging I found this website with some fantastic members helping people who have ended up in unfortunate circumstances like myself.

after reading @cp8759 's post helping another member of this community who was issued the same contravention I thought I would post mine in hope of receiving help of a similar fashion.

I have received a penalty charge notice after parking across the road from my place of work (Corsica Studios) on the 23rd of September 2024 at 18:51 (I will attach photos below). I have not yet appealed it and only have five more days to do so, should I appeal it now or wait for a response from somebody on here? Furthermore, I parked there as there was no other place for me to leave my car and I was already late for work on this day. I moved my car to the same side of the street as my work at the first opportunity I could and did not notice the pcn sat on my window when I did this. I thought I had received the penalty charge for being parked with one or more wheels over the line this was until I reviewed the cctv at my work and saw the councils dirty henchman giving me the ticket when I was parked across the street (I will provide google maps link below) this is the entrance to a building site that in over two years of working directly across the road from I have never seen anything go in or out. I also believe that the alleged contravention did not occur as nobody walking down that street (which is a rather busy street at this time) was effected by my car being parked there. this I can obtain cctv footage to prove. Any help on this would be greatly appreciated, I look forward to reading replies.

(the gate that has a sign saying gate 13 is the place i parked when i got my ticket and the unit opposite (number 5) with all the people stood outside is where i work.

I Rectract and apologise for my initial comments now realising that these pictures have been taken off the council portal and are available to anybody with the ticket information.

Although it's an entrance to premises, the PCN is still valid because the entrance is not part of the carriageway, it provides access across the footway. So I think you'll struggle with this one, as none of the points you have made are valid. HOwever, wait a bit and see what the others say, but don't miss the deadline for payment or submitting representations.

@jenno2550 well you're absolutely banged-to-rights on the contravention, as your car was quite clearly parked on a road but not on the carriageway, to an extent you were lucky that the car didn't get towed. If you'd parked closer to the gate I might have been able to construct an argument based on Pereira, R (On the Application Of) v Environment And Traffic Adjudicators [2020] EWHC 811 (Admin), but your car was too far out onto the pavement for any of that.

In the circumstances you might want to read up on the strategy of last resort and let us know if you want to try that.

yes i would like to try the last resort as i feel like im being unfairly punished for something that i see countless people doing and i did not cause any real issues i was just trying to work. thankyou for replying so quickly it is much appreciated

Sorry I posted pics quickly with no explanation. My view is the council CEOs mostly do a good job though under often difficult circumstances.

If this were me I'd pay the discount and find somewhere else to park.
