Hello, my first post here.
A PCN (Advisory Notice Only) dated 20th Jun informing about a contravention on 13th Jun. No penalty was imposed and the driver was warned that a PCN with penalty charge will be issued for the next contravention. This notice arrived on 9th Jul (26 days after the date of contravention).
On 27th Jun, the same contravention at exactly the same location happened, this time a PCN was issued with a penalty charge. The date of the notice is 23rd Jul and it arrived on 29th Jul.
Ground of appeal:
The first PCN (Advisory Notice Only) took too long to arrive. If it arrived earlier, it is possible the driver will receive the notice in time and pay particular attention, therefore the contravention would not have occurred.
The long delay of the arrival of the PCN (Advisory Notice Only) defeats the purpose of its very existence.
