Hi,


I have received an Oxford city council ECN pasted on my windshield after paying for the parking online with RingGo. The parking location & parking ECN are posted below.



The ECN says infringement code - 06, Unauthorised class of vehicle. Upon doing a quick search found from Oxford council's own website - https://mycouncil.oxfordshire.gov.uk/documents/s27341/CA_OCT2114R04%20-%20Parking%20Policy%20Annex%201.pdf



That code 06 means - 06 Parked without clearly displaying a valid pay and display ticket or voucher.



But I had done payment via App. I have my parking receipt from App, and you can't display it on car.



One person in the car park though told me that the parking inspector put a notice because my car was parked at a location where cars should not be parked.

Well, I did not know that, as when I entered the car park 4 cars were parked there and one of them came out and I got a place to park. So it was absolutely not clear if that was not a place to be parked.



On the photo you can see there is another volvo besides my car, that also had a Penalty stuck to it's windscreen. But there was a red Nissan on the right side without any ticket.

And a 3rd photo of cars which are not parked inside the bays obstructing parking. Also without any tickets.

I want to understand how and what should I make the appeal against. Also the parking charges are more expensive £100/£50(reduced rate) as opposed to £70/£35 standard council rates.

The point that there is both kerbing up to the where the cars are parked and that the area seems only rough gravel/dirt suggests that it is not an "approved" area to park in.

I think this is where you parked is is not - on the rough patch at the end?

The Nissan without the ticket might have arrived after the parking warden had done their rounds and ticket-ed all the vehicles that were at that time parked in this area.  This vehicle then left (with their ticket!) and the red Nissan arrived.  Maybe they will get a ticket when the warden next do their rounds or maybe they will get lucky and leave before that happens.

Yes that is where I parked on the rough patch at the end. And as I said on my post earlier, a car came out and gave me space and I parked between 2 cars. Highlighted in the image below:

My points for appeal as I see


1. ECN says Infringement code 06. Code 06 means "Parked without clearly displaying a valid pay and display ticket or voucher." Whereas I have online parking receipt.

2. The Google map street view shows, double yellow line in front of the kerb where I parked. Which makes it clearer parking can't be done there. GSV image below:

Oxford's ECNs are all illegal, because Oxford is a Civil Enforcement Area. If an ECN is not paid the only recourse is a criminal prosecution in the magistrates court, but regulation 8 of The Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022 says:


8.—(1) No criminal proceedings may be instituted, and no fixed penalty notice may be issued, in respect of conduct constituting a parking contravention, except a pedestrian crossing contravention.

Of court Oxford City Council would never accept this, but I'll be happy to come to Oxford Magistrates' Court with you if this goes that far (and while I can't speak for him, I'm hopeful Ian would also come along).

The following wording would suffice at this stage:

Dear Oxford City Council,

The car park in question is within a civil enforcement area, pursuant to regulation 8 of The Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022 you are not entitled to issue any notice under the criminal law nor are you entitled to bring any criminal proceedings in respect of any conduct which constitutes a civil paring contravention. In any event I did pay for parking and my vehicle is of a class authorised to park in this car park, so your case really doesn't have legs in any event.

Yours faithfully,

That the car was not parked in a bay or whatever else doesn't really matter, they can only pursue the allegation on the face of the notice, pursuant to Article 6 of the ECHR which states:


3 Everyone charged with a criminal offence has the following minimum rights:


(a) to be informed promptly, in a language which he understands and in detail, of the nature and cause of the accusation against him;

So, they can only really pursue you for parking a vehicle of an unauthorised class, if the car park bylaws says your vehicle is an authorised class of vehicle they can't chop and change the allegation and later say your vehicle was authorised but parked in the wrong place. If their silly little data terminals don't have the right contravention wording for "parking in a restricted area in a car park" that's their problem, not yours.

I'm not sure yellow lines would make any difference, one way or the other.

I have got a response where they have denied to cancel the ECN. Below response:

The first line of the response says that ECN was issued as it was parked in a parking bay which was not for this class of vehicle.

There was no such signage there mentioning that my car can't be parked there.



Please advice.

@akd1426 realistically the only way forwards is to call their bluff and take the matter to court, I'll tell you now that I'm happy to come to court with you and I suspect @Nosy Parker will be willing to act as your representative at the hearing, with a bit of luck we'll mop the floor with them just as we did with Norfolk Police.

The first question is therefore if you're happy to pursue this, if so (and assuming Nosy Parker is able to assist) it would make sense to instruct him as your solicitor now and inform the council that he's representing you, so that they can send the papers directly to him.
