Any advice on the following would be appreciated

Notice to Owner, Queensgate, Beverley, East Riding of Yorkshire Council.
Parked for longer than permitted Code 30 Controlled Parking Zone



Location










Part A
The Vauxhall is usually parked about half a mile from my home, on a quiet dead end street. This location is subject to a Controlled Parking Zone (CPZ). The parking is Mon-Sat 8am-6pm 4 hours No return within 2 hours
It is only used on an occasional basis (every 10 to 14 days), and I do not see the vehicle every day

I have never gone to the vehicle and found a Penalty Charge Notice (PCN) on the vehicle. I believe that the PCNs have been removed by persons unknown. The parking location is on a busy route to school for 11 to 18 year olds.<br>
Never having seen the PCNs I was not able to take the offer of a 50% reduction in the penalty. Can I request an offer of this reduction due to the circumstances?


I do intend to appeal the Notice to Owner



Part B

I do hold a digital Residents Permit (RP) for the Controlled Parking Zone (CPZ).
When applying for a RP you are asked for a vehicle registration number, it clearly states “this can be changed at any time.”

I own two vehicles a Vauxhall and a Nissan, the RP is usually on the Vauxhall

Sometimes the Nissan is parked outside my house where the parking is Mon-Sat 8am-6pm 2 hours No return within 1 hour. I have had occasion to put the RP on the Nissan for a couple of hours and then transferring it back to the Vauxhall, within the 4 hour period allowed at the Vauxhalls location.

An email is received stating “There has been an update to the vehicle registration details on your permit.” It is unfortunate that no vehicle details are given.

In the past a Civil Enforcement Officer (CEO) has observed the Nissan at 08:30 checks the vehicle registration number against the digital RP and finds no valid permit, at 10:00 I put the Nissan on the RP, at 12:00 the Vauxhall is put back on the RP.
The CEO observed the Nissan at 13:00 and issues a PCN, having no way of checking what occurred between 08:30 and 13:00
I have appealed this in the past and the PCN appeal has been allowed

It is my belief that on the dates in question the RP was taken off the Vauxhall and then replaced within the timescales
It is unfortunate that I had a clear out of my emails, prior to receiving the NtoO


In order to mount a challenge to the NtoO, can I request the East Riding of Yorkshire Council provide the following

Details of the observation times

Copies of emails sent stating “There has been an update to the vehicle registration details on your permit.”

Details of the date and times of any changes and the vehicle registration numbers

This is nothing to do with a permit - it's just a free 4 hour parking bay and the CEO has recorded wheel positions to determine an overstay.

Are you saying you usually leave the vehicle there for longer than 4 hours?

If there's nothing else to go on, making reps that you didn't get the windscreen PCn should see an offer of the £25 discount.

I found it difficult to express my meaning

I do have a digital parking permit for the CPZ
The registration number on the permit can be changed at any time

As I understand it I can park in the bay free for 4 hours, without penalty.
I can then put the vehicle registration number on the permit and stay for as long as I like

In the past the CEO has observed the vehicle within the free 4 hours, checked his hand held device and noted no valid permit
Returning later they have seen the vehicle in the same place and issued a PCN assuming the vehicle registration number is not associated with a permit.

I do believe the handheld device is updated once a day and may not reflect changes of permit during the day

As the road is within the CPZ I never noticed it was a normal parking bay and not a residents parking bay

Lesson learned

You can ask for discretion concerning an honest misunderstand of the CPZ and that you are entitled to park in the zone as a resident permit holder, along with saying the PCN had disappeared from the van.

I certainly wouldn’t tell the council you are gaming the system.

You have ONE residents permit that you are quickly switching between vehicles before the end of the general public free time at each location so that when the CEO checks they see a permit and ignore the car.

Can’t you apply for a second permit?
