No u-turn, road closed, forced to?

My son is the black car turning right into the side road. He was visiting a restaurant.

He did not realise the road was closed (due to poorly placed signage) until he was committed into attempting to enter it. You can see in the video, he was then forced to reverse. He still went top the restaurant, situated a few meters up from the start of the side road and has proof of payment.

Is this appealable?

The contravention is performing a prohibited turn, with the suffix u for u-turn. Looks bang to rights except of course they must consider the road closure as a right turn is permitted there. The only way to have avoided this is to drive into the closed road which looks to have a no entry sign, depending on whether there was an advance road closed sign and there looks to be the back of one by the traffic island.

I have to say I think this is a very harsh PCN, a money-grubbing PCN frankly.It is obvious that the OP did not intend to make a U-turn, but the road closure can only be seen once the turn has started. So what in hell was he suppose to do for heavens sake !!
I would take them all the way to London Tribunals if it were me, but it's the OP's money.

Just received an email from the London Tribunals saying that my appeal for an alleged YBJ infringement is not going to be contested by Havering. I am taking that as a sign (pun intended) and will appeal this one now. If I draft an appeal, will you guys have a look-see for me?

Of course we'll look at it - we always encourage people to draft reps here.

But can you drive that way and check if there is a temp sign on the traffic island? If there is that's what they'll probably use in rejecting.

In any case you can make reps with no acknowledgement of any advance sign as it seems he did not see anything - have you asked?

The council will say that the vehicle should have driven into the right hand side of the road and then reversed. Assuming it was possible to do so.

IMO, was a U-turn manoeuvre performed?

I think adjudicators would say yes.

Is there strict liability or could a statutory defence be submitted at a hearing?

Given that the 'No entry for vehicular traffic' sign is angled toward the camera, IMO it would not be clear to a motorist approaching from the opposite direction. But as pointed out by stamfordman, there is what appears to be a circular sign on the pedestrian island which would have been visible. If the council have evidence of this sign and it lawfully prohibits a right turn then I could see an adjudicator rejecting any argument and considering the driver to be the architect of their own problem.

But OP, all you can do is test the authority's position with your reps.

Too clever/silly?

At the time of the alleged offence I was travelling to Miami Crispy, a restaurant located at 2 Claybury Broadway, Ilford IG5 0LQ.

My journey was to travel along the A1400 Woodford Avenue and then turn left on Clayhall Avenue.A final right turn onto Claybury Broadway would get me to my delicious destination.

Unfortunately, upon my right turn onto Claybury Broadway, I was greeted with a closed road. My only option, as you can see in the video was to sort or reverse/swing the car around. I then proceeded back  onto the A1400 to access the restaurant from a different direction.

Some people are born making poor driving choices others have them thrust upon them. This is very much a case of the latter and as such I respectfully request that the pcn is voided. I have proof of the visit to Miami Crispy by way of evidence. If you happen to be in the area, I can recommend the wings.

That's what I call winging it...

Who is the registered keeper as reps must come from them.

I would start it like this:

The contravention did not occur owing to circumstances beyond my control.
