7 PCNs from Birmingham city council - moved from Pepipoo

Hello everyone.

This is the transfer of the epic story of success from this very long, 7 pages thread http://forums.pepipoo.com/index.php?showtopic=144652

Summed up story. I have received 7 PCN's from Birmingham city council for not paying the clean air zone charge (please, don't ask). However, due to council being very, very slow in processing the court orders, and with the help of cp8759, Neil B, and others, practically all PCN's has been dismissed (some PCN were more than 9 months until they actually reached Traffic Enforcement Centre).

As it stands now, only one, the very last PCN is still open, the KW17059063. This PCN had revoking order issued at the end of September 2022, and cp8759 has submitted representations to Birmingham City Council on November 2022. Reason being, on November 2022, Council claimed that I haven't requested revoking order for this PCN, and therefore they will be enforcing it, make it rain fire etc. I did, however had a paper copy of revoking order, which has been submitted by cp8759, as evidence that I did requested it, and it was granted at the end of September (not sure how council was not aware of revoking orders existence, more than month after its issue).

As you may guess, Birmingham City Council STILL HAVENT PROCESSED IT! It's been almost a year now since representations been submitted, and I was checking the PCN diligently, every week, and it is still at £189 (just as it was before I submitted documentation to TEC to request the revoking order). I assume CP8759, who represents me, still haven't got response from Council, but as he advised me, the longer they drag this, the better it is for me.

So that's that. Once we bid farewell to pepipoo. My story will remain here.

I'd agree with CP...let sleeping dogs lie.

At the moment, you (CP) have done all the needful and the ball is in Birmingham's court.
Chances are that this will simply hang about and go nowhere.
I've known this with Birmingham over the years, they don't cancel but don't progress either.
Should they wake up and issue a new PCN, time is certainly on your side, unjustified delays are a winner.
If they do summat really silly like trying to enforce a non existent warrant... wow.

Just keep all your paperwork safe.

Hello Everyone!

Well, is it yearly, or maybe three quarterly updates?

Since my last update last October - nothing changed. The PCN still appears as £189. I haven't got any letters, calls, or emails.

Still playing this waiting game. However, I am moving the address next month, would it be a good idea to email them and ask (like I had to do before) to send any future correspondence to this and that address? As I wouldn't like to get a surprise visit from a bailiff, in case Birmingham council will go "Oh sh*t, we totally forgot this guy" at some point in the future. It has been over a year and a half since cp submitted the appeal and over two years since the PCN issue.

Is there anything for me to do when moving the address (apart from informing DVLA and getting V5C updated, learned it the hard way)?

Remember: just as updating driving licence does not update V5C, nor does updating V5 update licence!
And also tell the council that you have moved to a new address, and requesting that all future correspondence related to the PCN be sent there.

Despite the time which has expired since TEC revoked your OfR in respect of the above, I note that it still remains live on your books. As I am soon to move house, I am therefore obliged to notify you of this change which is as follows:

Wef ***** amend ***** to read *******.

Even better would be for the council to put this saga to bed and formally cancel the PCN.

I agree with @H C Andersen and that will hopefully be the end of the matter. It's been long enough that any attempt by the council to pursue this further should be seen as an abuse of process by the Traffic Penalty Tribunal.

Don't forget to inform your motor insurers of the change of address and the date this will apply from prior to actually moving as the last thing you want is to have to make a claim and having it declined due to not informing them of the change and possibly paying any increased premium.

Plus: make sure you have mail forwarding set up with Royal Mail to make sure stuff addressed to your old address gets sent to the new one. Costs but a good insurance.

Hello everyone,

Thanks for your responses.
I have updated the V5 documents and my driver's license online (so much easier now) and received copies with the new address.
I also sent the Birmingham council contact form requesting "any and all corresponding PCN reference xxxxxxxx, to go to a new address provided below"
Oh, I also updated my car and even home insurance address (both come from tesco).

I believe I ticked all the boxes (including mail forwarding).

Update:
The email responses were, shall we say, less than illuminating. 
A phone call clarified things... sort of. Apparently, my address is now a historical artifact, permanently linked to a 'Revoking Order' from back when dinosaurs roamed (or, November 2022, same difference). 
Despite explaining I've moved again since then, they insist they can't update it. 
The case has been 'with a supervisor' since said dinosaur era, and they're in no rush. 
Their solution?  'Just keep an eye on your balance. If PCN payment request suddenly drops to £60, call us.' 
So, basically, I'm supposed to monitor a PCN website, for a potential postal notification sent to an address I no longer live at. 

Brilliant.  This three-year-old PCN is clearly determined to outlive us all.
