Newham, code 01a - Parked in a restricted street (Temp traffic order), Green Street

Hi FTLA,

I received a PCN on the windscreen whilst popping into a shop to get a 18kg bag of flour which took about 4-5 minutes in total - the shop was right opposite to where I was parked. Currently, there are roadworks on Greet St at the junction with Plashet Rd and Plashet Grove. There's usually a loading limit of 30 mins at this time (before 12pm) but currently the bay is suspended due to the roadworks. I didn't see the bay suspension notice due to a van parked in front of my car, which had its back doors wide open and obscuring the sign.

The photos below contain the PCN and 3 uploads from the council website.

I'd appreciate any help in cancelling this PCN. Thanks

Loading would be an exemption.

Shopping is not normally considered as loading, but it's a case of the facts.

What evidence do you have of your purchase?
Was this all you did while parked?

I paid using my debit card so have that via the banking app. I was handed a till receipt too but currently the whereabouts are unknown.

I only went into this one shop and immediately returned to the car once I had paid for the flour.

Most people don't just arrive at a shop and decide to buy an 18kg sack of flour, so I assume you must have ordered in advance. If so, this would not be classed as shopping, so the loading exemption should apply. Certainly, 18kg is pretty large package to carry any distance.

So tell us more; is the above a correct summation ?

Yes the above is correct. I had called ahead and once i arrived, the package came to the front of the store on a hand truck/trolley. I paid and the store assistant used the hand truck/trolley to deliver the sack of flour to the boot of my car which is when I saw the PCN on the windscreen and the warden walking away. I did not engage with the warden.

I see this has crossed with the last post..

Were the goods pre-ordered by any chance or set aside in another way?

On another tack, can you revisit and in the length of road on your side which is specified in the sign you posted take photos. We need to see what other similar signs are within this area and also whether the sign in the photo is on your side of the road.

The goods weren't pre-ordered. I called ahead to ask whether they had the flour in stock, which they did so they set a bag aside for me.

I'll try and revisit the area sometime this week. Is it the bay suspension sign(s) you are interested in seeing along the area of road?

OP, these questions might seem odd and possibly irksome, but take it we know what we're looking for.

A Temp Traffic Order has unique signage requirements which in the main councils get wrong. It is NOT the suspension of a bay, it is an order whose provisions in whole or in part suspend existing statutory controls - made under another traffic order(s)- to do which more onerous(than normal) signage requirements apply. Hence we need to see far more than the CEO has photographed which, if they think this is sufficient, suggests they don't know and therefore that what's in place is non-compliant and inadequate.

Also, the PCN states I was parked "os joyalukkas", but i was parked outside Crystal which is 2 shops away. Does this make any difference?

I don't think so, because the suspension sign includes Crystal. Are there suspension signs on the opposite side of the street because according to the sign, the suspension applies on both sides.

There are no signs on the opposite side of the road as there isn't a parking bay on that side. Opposite side of the road only has double yellow lines. Green St would come to a standstill if there was parking on both sides as it's one of the busiest roads in East London.

But double-yellow signs allow loading, so with no signs there, somebody wanting to carry out loading would have no reason to cross the road to look at the sign.
So the suspension signs are inadequate.
