Moving traffic offence Redbridge council

Hi I received PNC for moving traffic offence on 11/02/23
The council did not send me a PCN for the above mentioned dated
I asked for help on the face book social media group for parking tickets
I am in touch with IVAN Who is helping me through out the process
We had to waiting for the council to file a debt and when filed we sent A PE2 form and emailed to Traffic Enforcement Centre at Northampton County Court.
Received a reply reply stating
Declaration has been filed in order for recovery of unpaid penalty charge to be revoked
This order doesn't cancel the original PCN as the council may take further action
Next day received PCN from the council for the original dated
I've been in touch with IVAN his sending me a letter to send to the council soon
Can't say enough thanks to Ivan for helping Through the process

Also you'll note I've moved this thread to the council section, you'd posted it in the private parking tickets section for some reason.

When the council sent you the Order for Recovery, did they include a copy of the original PCN in the same envelope?

Dear London Borough of Redbridge,

I bring a collateral challenge against PCN AF97011707 on the basis that the council has departed from the requirements of the London Local Authorities and Transport for London Act 2003.

Paragraph 6(2) of Schedule 1 to the Act provides that:

Any notice of any county court order made under this paragraph and being served on any person shall be accompanied by a copy of the penalty charge notice to which the penalty charge relates.

This is a mandatory provision, however no copy of the original penalty charge notice was served with the Order for Recovery, this means that I was unable to make representations against it upon service of the court's revocation order.

In light of the above, the penalty charge must now be cancelled.
