Merton – Bus lane PCN, straddling lane to pass bus before left turn – Wimbledon Hill Rd

Hi all

I received a £160 PCN from Merton Council for being in a bus lane. This was on Wimbledon Hill Road around 5pm on 21 May.

I checked the evidence and my car is only partly in the bus lane. I was straddling it to pass a bus that had stopped right ahead of me while I was about to turn left. I turned left shortly after. My left wheels were in the bus lane briefly but not the whole car.

I’m not sure how strict the rule is. Does any part of the car being in the lane count as a contravention, or is there some room for judgment if it was quick and for a practical reason like passing a stopped bus or preparing to turn?

First glance tells me this is a contravention, because your car is mostly in the bus lane. However we need to see the video to confirm this.

I'll be back with a draft once we have a PCN and VRM with which to work. cp8759 and I have won every case against this council even though they have learnt a little as a result. They still have to turn up. Hence my petition.

Dear Merton

The alleged contravention is not proved because there is no evidence of signage allegedly passed and clearly the vehicle is not fully over a white line and the legend is not clear either that this was a bus lane.  Please cancel.

Hi Hippocrates, apologies for the delay, I didn't get the notification and missed your reply. For further context, here's a screenshot that shows the corner where I came from, where the only sign I can find is located that even mentions a bus lane camera and where the "BUS LANE" writing on the floor is located, (which isn't very visible unless you were coming straight on that same road). At the end you can see where I make the turn left right after driving half the car on the bus lane. You think I should argue this?

If it were me I would have not entered the lane at all because of cameras but there comes a point where a jam surely makes it unreasonable and there are two buses here. But unreasonable is still only mitigation and not circumstances beyond one's control unless there was an accident or such like.

But the council can use discretion and hopefully the website issue will also see this off.

I'm just pointing out there is a reasonable ask on the contravention owing to obstruction, which can be added to representations.
