URGENT ULEZ PCN from Transport for London

Posted on pepipo my original upload on here I can’t find.

I went to visit my grandfather in Catford Lewisham area in London on the 28th of July. I stayed overnight and returned back home on the 29th of July.

A week ago, I got a letter through the post that I didn’t pay the ULEZ charge zone not once on any of the signage in London. Did I see it says that you were being charged for ULEZ.

My car was complaint with ULEZ at the time I bought it but it looks like there’s been a revision at some point dollars which means my car is no longer compliant and I can see online as a daily charge of £12.50 for my vehicle.

If I saw on the signage anywhere about, ULEZ charging zone or that I would be charged I would’ve made sure to have paid this. I now have been given a fine for both days being in London £90 each day.

Is there any way out of this? especially because for example the congestion charging zone it clearly says congestion charging zone whereas in London it doesn’t say you’ll is charging zone so you don’t actually know if you’ve been charged for it or not.

Since then, I’ve seen a lot of adverts about it, but I wasn’t too sure about how it worked before now and that my car was no longer compliant or mid understood when it said £0 to pay in my grandads post code SE6.

How did you know it was compliant ? Did you enquire on the ULEZ website, or just accept what the seller told you ?

Do you live far away from London ? Publicity for the ULEZ especially its recent extension has been all over the media. The ULEZ has been in operation for some time now.

The CC zone has to be paid by almost all cars entering it, the ULEZ only old petrol cars and diesels mainly before late 2015. There isn't really a guaranteed way out, I'm afraid.  ALl you can do is submit representations. Before you do this, explain about the car being compliant when you bought it. Also read the final sentence at the bottom of their web page for your car : -

The car was certified as Euro 5. And the V5c confirms that the NOx emitted by your Golf is above the Euro 6 limit, 0.124 g/km and the limit is 0.08 g/km. The Golf is not compliant with the required emission standard.

The car never was Euro 6 and absent any evidence that the TFL checker said it was compliant back in March then there's no way to challenge the status.

Page 2 of your Notice of Rejection dated the 11th September gave you a further 14 days to pay at the discount rate of £90 per PCN.

I expect that you're now outside that window. However looking on the TFL site it looks like they'll still accept £90 per PCN. So my advice is to pay the PCNs at £90 each if you still can. Get it done now, this morning. Don't delay or you risk the charges rising to £180 each.

If you want to appeal to the Adjudicator then the full PCN amounts will be in play. There will be no discount option if you lose. That's £180 per PCN. I don't see anything to suggest you can win at Adjudication.

Could I argue the signage doesn’t specifically state it’s a Charing zone I have found that is the excuse some use to get out of it but this was a few years ago I don’t know how easily it can be done now

Well, you can try it, but if you lose it's 2 x £180 = £360

I know what I'd do !

You haven't told us why your car was apparently ULEZ compliant when you bought it.

I've looked through the last two months worth of Adjudication records, from the London Tribunals website, for "A4 Great West Road". Which is the location on one of your PCNs. 21 appeals refused and 33 allowed. Just about all of the allowed are due to DNC (Do Not Contest) by TFL. Not one case has been allowed for defective signage.

Case 9230377538 concerns a 2015 VW Golf Match 1.6 TDi Blue Motion Tech, so very similar to yours, with three PCN appeals refused.

A couple of the allowed cases involve cars with personal plates that were incorrectly flagged as non-compliant. We've eliminated that possibility in your case.

The Adjudicator has to deal with the facts and can't take mitigation into account. Mitigation is for the Enforcement Authority. In this case TFL. And TFL have turned you down.

So the adjudicator will consider the photos that show your car infringing the zone and any evidence concerning the emissions standard of the car. You'll lose on both.

You won't win if an Adjudication hearing goes ahead. Unless you strike lucky and get a DNC from TFL. It's a gamble. £180 now to close the cases or £360 in a couple months if you lose.

So my advice is still to pay both the PCNs immediately at the discount rate, assuming it's still available on the TFL site. If you've missed that deadline and the discount is no longer available then I suppose you should have a go with the Tribunal  as you have no financial incentive to do otherwise.

The discount option is due to disappear imminently. Hours, not days or weeks.

One person and it was two years ago -- and only because TfL failed to supply the necessary evidence that the signs are lawful.

More recent adjudications mention the authority for the signs and it seems well known by adjudicators.
