Hello,

I received the pcn in post. I cannot see any video evidence in the tfl.gov.uk website. I am confused, is it that they do not have it or that they did not provide it to me and will do if I appeal?

After some online research I understand that I can appeal by saying:
“The still photos provided do not prove the contravention. I have not been provided with the video footage and am thus unable to review the incident with a view to mounting a defence. Please see case references 2210739628 and 2180479025 for cases won by motorists at adjudicator when the authority has failed to provide the video.”
Is this correct?

Annoyingly, TFL only provide the video on request.  You'll need to call them and ask for it, following which they'll post you a dvd.  They usually put the case on hold for a couple of weeks while you wait for it to arrive.

Thank you so much for your quick response. I did not find any phone number. I did however find this form:
https://content.tfl.gov.uk/traffic-monitoring-cctv-subject-access-request-form-2019.docx

Is this correct?

According to their website you can reach them on 0343 222 3333

A subject access request may be a more "nuclear" option.

According to their website you can reach them on 0343 222 3333
This is the number to request the video on, so ring first thing on Monday and ask for the video if you have not already done so. They will put the penalty on hold for 14 days while you wait.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

what time into the video do we need to look at

Hi, its at 2:41
sorry didn't mention before

For reference, the money shot seems to start around 2 mins and 30 seconds into the video (a black Jaguar)!

Oops, beaten to it!

This junction must be a huge money earner.

TBH, you do look to be totally bang-to-rights on the actual contravention, because you entered the box and instead of ducking in to your left where there seems to be a space, you just stopped behind the gold-coloured car that came in alongside you on your right, and took the space on the other side of the box. This is the classic contravention scenario !

Can you tell us more, at all ?
