Author Topic: Lewisham, code 53j slightly drove into a restricted school road, Pragnell Road Junction of Kingsland road  (Read 1991 times)

On the morning of January 24th, I took my kids to school. Their school normally closes its gates at 8:50 AM, and that day there were no parking spaces available nearby. However, I found a parking space near the pedestrian and cycle zone around 8:40 AM. I quickly parked on the pavement near the signage to get my kids into school before the gates closed. While manoeuvring to park properly on the pavement and avoid pedestrians and the car behind me, I accidentally drove slightly past the restricted pedestrian signage, which caused my front tyre to cross into that area as I parked.

Sounds like a council matter not criminal.

I'll alert a mod and get them to move it.

For meaningful advice, please to have a read of
https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/read-this-first-before-posting-your-case!-this-section-is-for-council-tfl-dartme/

and post here all sides of the PCN (redacting only yr name & address) and a GSV link to the location.

Follow-up on PCN and GSV Link

Hi,

I wanted to follow up regarding my previous post, as I’m unsure if the links to my Penalty Charge Notice (PCN) and Google Street View (GSV) were successfully attached and seen. Unfortunately, I can’t see them in the message.

Additionally, I would greatly appreciate any updates or feedback regarding my case. Your insights would be invaluable as I navigate this matter.

Thank you for your attention to this issue, and I look forward to your response.

I posted about my PCN issue and shared some images of the document back on January 30th. Just a heads-up, tomorrow would be 14 days since the penalty letter was sent out, and I know that's when the penalty fee would go up.

Could someone please take a look at my case and get back to me? I’d really appreciate it!

Thanks.

A typical money-grubbing PCN. Video ceases just after you moved slightly past the sign. You should submit representations that you were manoeuvring to park and just went past the sign by about 1/2 metre. You state that you consider this to be a trivial offence as you did not continue to drive down the restricted street, but reversed back into a parking space. Say also that you are sure they did not intend to penalise parents taking their children to the school on the restricted street who inadvertently intrude slightly into it when parking.

A question of law:
Does 'to enter' in this context mean to pass completely(the sign on the driver's left)?

OP, the council's webpage states:

The amount outstanding on the Penalty Charge Notice will increase to £130.00 on Mon, 17 Feb 2025. Please pay £65.00 now.

The reference to 14 days in the PCN is a reference which the council is required to include in a PCN. However, it does NOT mean that this limits them to enforcing this period i.e. as a matter of policy they may extend this. If they do, then IMO this is the standard which applies.

You have until 16th.

@Incandescent!

I AM ABLE TO TAKE ON MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. I HATE RETIREMENT.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

The date re increase is wrong. Please keep a screenshot for further use. Their website is the main reason why we win appeals at the Tribunal. Two last week.

Thank you, @Hippocrates, @HC, Andersen, @Incandescent, @John, U.K., and @FuzzyDuck for guiding me in challenging the penalty charge notice. My representation regarding the PCN was accepted, and the penalty charge has been cancelled.
