Hi, I've parked overnight on Garratt Road in Edgeware on a single yellow line. I parked up at roughly 17:30-18:00 (it was dark at the time) on Saturday 18/01 and left at 9:50 on Sunday 19/01

I parked with 2 tyres on the pavement, trying to keep the narrow road clear for cars. I had my mirror tucked in on the images supplied by the council. I am lined up with other vehicles parked in marked bays that protrude onto the pavement. I don't see my vehicle as being any more obtrusive to the footpath than the marked bays.



After reading through similar posts on this forum, I am now aware that parking on the pavement has been banned in London since the 70s (1st time driving in London, from Leeds). However, I was wondering if there was any chance this fine could get canceled due to the reasons mentioned above.

I can't see any signs about 2-up footway parking in bays and nor I can I anything in Barnet's traffic order map.

This means one of two things.

- The 2-up bays have no legal status but Barnet put them there anyway

- There is a resolution disapplying the footway parking ban in the road/area.

+1 to Stamfordman, but we need to check the status of the street, so wait a bit, (Mr Mustard is a good "ferret"). Lots of councils pass the relevant resolution for allowing off-carriageway parking, and then think a bit of paint on the footway & carriageway is sufficient to restrict the exact area for this, but it also needs to be in the resolution itself.

So there is hope !

I haven't met this location before.

Two council decisions are required before footway parking can be tolerated.
A resolution of the council itself, which I don't think exists.
A traffic order to give effect to the resolution.

The traffic order is map based and footway parking is shown by a bay which is drawn partly on the footway.


Having had a read of chapter 13 of the Traffic Signs Manual Chapter 3 I think there should be signs and this is probably the best representation to make that the council have not put up signs which show the extent to which footway parking is allowed and given the lack of clarity the PCN should be cancelled.

As always, to win you have to forget about the discount and be prepared to go to the tribunal if the council reject your representations at the PCN and Notice to Owner stages, as they probably will.
