LB Hackney PCN, code 21 suspended bay, Horton Road E8

Hello

I received the following in the post this afternoon:

Quick summary of the story from my side - car was parked directly outside my house in a resident's bay. One morning, I noticed a warden in the process of issuing a ticket - initially thought perhaps our resident's permit had expired but no, the 3 bays outside our house had been suspended. Hadn't noticed the sign before the incident, no idea how long it had been there.

The suspension kicked in at 8.30 that morning, warden was issuing tickets around 8.40 (time on the PCN is 8.42). I immediately jumped in the car and parked on the other side of the road where the bays were not suspended, and before the warden had printed the ticket.

Received the PCN linked above just over a week later.

The whole thing just feels a little... unfair, somehow! But maybe that's just me.

Any advice gratefully received.

Please post the PCN and do not redact PCN Number and car reg. We can use them to look at any photos taken by the CEO.

You've had a lucky escape here I think and I think I know why it happened.

Assuming there is no disputing the contravention - you were in the suspended spaces and stopped the CEO serving the windscreen PCN - they've sent you a PCN for £80 when it should be £160.

Online it's £160 (£80 at discount), so they are asking you to pay more than the penalty asked on the PCN.

On 7 April, the date of the PCN, London penalties for this contravention in band A areas went up to £160 from £130, and it looks like their system has a glitch (not a first for Hackney).

Hi Stamfordman - this is happy news!  :)

Could you advise what the best way to appeal is? Looking through the list of "statutory grounds for making representations" on the back of the form, would the best option be to go with "Any other compelling reason", explain that the Hackney payment webiste is asking for more than the amount specified on the PCN, and provide the screenshots you've helpfully pasted below?

but not sure how this works with a PCN vs website issue. What I do know is that what's on the PCN is what counts.

Wait for others to comment - there is no rush. I wonder if they can say we'll accept £40 discount (but that will have saved you £40 anyway).

Another thing - you say you parked across the road - was the CEO still around?

Thanks all, I will wait for others to comment.

In answer to previous questions - yes Stamfordman, I parked directly opposite and the CEO was still there. He didn't say anything but moved on to another car parked in the suspended section, presumably to issue a ticket.

And re how long the car had been parked - it was definitely used the previous day at some point (the Sunday). I guess we just didn't notice the suspended bay sign.

I'm not sure what the rules are - I assume the CEO couldn't serve the PCN on the car if it was reparked but maybe could have given it to you.

Anyway, you are deprived of the opportunity to pay the £40 discounted penalty as on the PCN as attempting to pay gives only the option of paying £80. This is a procedural impropriety.

Thanks all for the helpful advice.

I am planning to submit an appeal to Hackney as follows -

Grounds:
There has been a procedural impropriety on the part of the enforcement authority

Explanation:
"This PCN was received in the post as the vehicle was moved out of the suspended bays before the CEO had time to issue a ticket.

The PCN states that 'The full amount of the penalty charge is £80.00'. It goes on to state that 'the Penalty Charge is reduced by 50% to £40 if paid no later than the last day of the period of 14 days beginning with the date on which this Penalty Charge Notice was served'. However, the LB Hackney PCN website states that the full charge is £160 (NOT £80) and is currently offering the opportunity to pay the charge at a reduced rate of £80. I have therefore been denied the opportunity to pay the reduced charge of £40 as stated on the PCN. This is a procedural impropriety on behalf of the issuer.

I look forward to receiving confirmation that this penalty charge has been withdrawn."

Does this adequately cover things? Would it be worthwhile to include screenshots/scans of the PCN and payment page? Grateful for any suggestions.
