LB Camden - Fail to comply - Jamestown Rd NW1
« on: »
Hi all,

The wife picked this one up. Looks bang to rights, but any advice on any possible technical challenge would be greatly appreciated. Thanks!

OP---Looks bang to rights.

This looks like the original set up:-

I would contend that a 619 sign (flying motorbike) is required on the left and that the right hand sign is merely supplemental to that requirement.

The Council have to set up traffic signs properly under:-

IMO the signage is inadequate but it would be a struggle to convince the Council.

Many thanks for the info Mike.

We did have a look back in time on GSV (wife didn’t remember the restriction being there before) and saw the clearer signs from 2021. Signage is poor at the moment, as you say, so perhaps worth a challenge on that - signs have been poorly maintained?

But I’ve told her to prepare to pay!

The traffic order is The Camden (Arlington Road Low Traffic Neighbourhood) Traffic Order 2022, I'm not aware of any flaws but someone else might spot something.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

Hi again Mike,

Regarding inadequate signage, I did a little digging and found this, (albeit from Southwark):

https://www.southwark.gov.uk/assets/attach/4680/DS-300-Overaching-requirements-and-principles-for-signs.pdf

It seems councils are ‘decluttering’, with respect to signage, so my idea about poorly maintained signage might be a no go-er.

OP--Apologies I missed your response.

On decluttering, I would argue great! but the Council has removed the wrong sign.

We drive on the left and a driver would expect signage to be on the left in his or her sightline.

+1 to Mike.
I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
