@H C Andersen

Thanks for the reply.

London councils are really frustrating as they all have different parking rules for motorcycles which change, often with no notice. In the past in Lambeth it used to be free to park anywhere, this changed in 2020 and back when I was living in Wandsworth I parked in Lambeth and received a PCN, so became aware of the change and thus now check councils websites before I set off as the info is only ever on their "motorcycle parking" section.

I don't know where all the council boundaries are, I knew my battery was low so checked the site on where it would be safe(free) to park and then set off. I couldn't check once I arrived as my phone was dead and there was no visible signage to indicate one way or the other. The info is often hard enough to find which council you are in, especially when on boundary lines so the map provided in my head made sense as its blank in spaces. Just frustrating, the top half of the map is complete but missing the bottom. If I knew I was still in Lambeth I wouldn't have parked there and would have driven around looking for a motorcycle parking

Hi @cp8759

I have updated my letter with a second draft hopefully heading more in the correct direction with your advice. (I will create a new link before sending)

To whom it may concern,
I am making a formal challenge due to my informal challenge’s raised points not being understood and taken into consideration.
Prior to my journey I had checked the information provided on the Lambeth Councils website and used the provided map https://2ly.link/1yHY8 so it was understood to me that the council line ends as per the map. You can clearly see to the top, left and right of the map where it is clear, so why does it not end at the bottom or include the whole council to avoid confusion, especially when viewing from a mobile phone. As someone with ADHD I find that this could easily confuse other people as the map is not clear and complete. Due to this I understood I was out of Lambeth council and would have been able to park here without payment.
If this is not sufficient, I make a plea for discretion from the council. I am on Universal Credit currently whilst fallen in hard times and the payment unfortunately doesn’t even cover my rent and am in debt to pay for food, I cannot afford this. The fear of this cost is adding additional stress and anxiety to my situation which feels unjust.
I am asking for this fine to cancelled as well as this map to be updated properly as can be easily misunderstood by anyone, especially someone with learning disabilities.
Many thanks,
NAME

@silentbob I've had a look at linkly and you can look at the click stats on the "links" tab, without having to actually open the link yourself. I've set up a test link to this thread and this is what it looks like:

If when you get the notice of rejection the "total" number of clicks is still zero, you've got the evidence you need. You'll just need a screenshot showing that page on linkly and another browser window show the https://time.is/ website (just to avoid any suggestions that you changed the date on your own computer).

I think you need to include some supporting evidence regarding your financial circumstances, such as bank statements, letters from creditors, universal credit etc, the more the better. This should all be provided by means of additional links.

Mitigating evidence is in some ways more important because only the council can allow an appeal based on mitigation, so a failure to consider mitigating evidence is arguably far more serious because it cannot be put right by the adjudicator.

Thanks @cp8759

Yes, that’s it, pretty decent for a free product (free for first 1000 clicks) exactly what is needed.

I will upload my bank statements (privately), loan agreements, UC income slip etc and create unique links for each of them and include them in my letter daft that I had posted in my previous message.

Once updated, unless you think there is anything else to add I will get it sent off first thing tomorrow.

Thanks again for your time and help, hope you have a great evening

Hi @cp8759 & others, I hope all is well.

I have just received the reply from Lambeth parking services and it has basically been the same response as my original reply basically ignoring my points as well as not clicking the links that were provided, success!

I have updated the main onedrive link and added this Onedrive folder link.

I have just received the letter so thought I would post it and will read through it all again to start working on the appeal.

Thank you

@silentbob you want to select "linkly link" from the "column visibility" dropdown, as you need to prove that the link in the screenshot matches the one you put in the representations (the screenshot you have does not link back to what's in the representations, you could have made two sets of links, one to give to the council and another to make a screenshot for the tribunal).

I'm going to drop you a PM in case you'd like to be represented.

@cp8759 I would complain you did not get a mention.  :D Or did he do it himself?
