Lambeth - Code 40 Parking in disabled bay, Union Grove, Lambeth
« on: »
I parked directly under a sign for which I have a residents permit, unknowingly with my front tyres in a disabled bay. Worst part is I didn't use my car again for a week or walk past it as it's not where I usually park. Managed to collect 3 fines totalling £240 (That's if paid early rate). I believe the road markings are so worn and barely legible that it is reasonable I didn't see the line I'm parked over, or the disabled bay writing. Hopefully you agree and think I can appeal?

I would really appreciate any help, thanks very much everyone.

I think you have an excellent case for inadequate signage, because the road markings are part of that and have virtually disappeared. One has to go back to GSV 2019 to see the markings in good condition.

If the car didn't move the second and third PCNs are a continuous contravention and must be cancelled.

Not so sure the single line bay marking is that unclear but you were at the opposite end to the sign and there should be a gap between bays of different types:

Where two bay markings, associated with different conditions, are sited next to each other there should normally be a gap of about 100 mm between them. If adjacent bays would normally have different widths, the greatest width should be adopted for all to avoid a potentially confusing stepped edge.

I think also the road legend designating it as a disabled bay must be there and clear. The width of the disabled bay must be at least 2700 mm and then so must adjoining bays unless it's a narrow road.

I finally have an update on this!

One cancelled for being within 24 hours of another

One appeal rejected but there is no reference to my argument about the road markings being worn so i'm a bit confused

One that I'm still awaiting a response on (Submitted 13th October!)

I'm still adamant that these road markings are absolutely invisible once it's rained but I'm wondering if I cut my losses and pay the reduced fine. Attached are a few more pictures taken when the road is clear from debris but wet. Few more images taken from different angles, in similar conditions to when I parked up

And thanks for the advice so far - much appreciated.

Can upload the response to the appeal if helpful
