Hackney - 31 Yellow Box - Eastway/Wick Road junction
« on: »
Hi,

I have received a postal PCN from Hackney for stopping in a boxed junction - unfortuantely I was not familiar with the area and didn't realise that I should have been in the left lane until I have already entered the boxed junction.

I should probably have just moved to the right lane but hey you live and learn!

Would appreciate guidance on whether anyone can see any grounds of appeal whether based on the videoor the PCN. Otherwise I will probably see to pay the discounted rate before the deadline.

PCN:

Is that the video in it's entirety? It starts with your vehicle already in the box, which is not sufficient evidence of an offence as it depends on precise traffic conditions at point of entry.

Yes that's the entire video which I have downloaded from Hackney's PCN page at https://parkingdisputes.hackney.gov.uk/pcnonline/

Prepared a brief informal representation on the observation Mr Chips made. Any input welcomed.

The video does not show the situation upon alleged entry into the boxed junction and so it follows that the alleged contravention is not proved.  I refer you to the following cases: Place Invaders Ltd v TfL (22/09/2004), reference MV0001GT01 (https://www.londontribunals.gov.uk/sites/default/files/keycases/Place%20Invaders%20Ltd.doc); Jeffrey Gentzler v Havering (16/03/2024), reference 2240046143; Patrick Hallissey v Havering (12/04/2024), reference 2240029712.

In light of the above, please cancel the PCN.

Ok, in that case you should win if you see this through to the end. There are numerous adjudication decisions backing this up.

Give time for others to chip in opinions and any other viable points of challenge but it should be a pretty straightforward representation to draft to Hackney.

I have the similar case within this thread, having received a PCN, and not knowing that the road technically was going straight, I entered the yellow box thinking it was a right turn, forgive me I’m new to this site, so I’m still unsure how to attach my own screenshots and messages
