Author Topic: Hackney Borough Council, driving on prohibited road, Elsdale Street - baliff  (Read 448 times)

Baliff involved- but currently on freeze while TEC involved.


So, long story short. I was sent a picture of me apparently driving down a prohibited road in Hackney. This was a shock to me since I never go to Hackney and the photographed car wasn’t mine. In the same week I also entered the congestion charge zone in the same vehicle that isn’t mine…

So anyway, my plates were cloned. I called the police, I got a crime number, and I appealed both letters. TFL cancelled the congestion zone one, and I heard nothing back from Hackney.

I was then informed by another letter that they had rejected my appeal (I didn’t receive anything!). I’m not good with these things and had then had to called the TEC who advised I send another form in which was rejected as I hadn’t had it counter signed. My error…but I’ve never done this before. I then got chased by Newlyn the debt collector who knocked on my door. After calls I had been informed I could send an out of time form, I had both forms counter signed by a solicitor and I emailed this back in with photographs of my vehicle (a 2005 Corolla) and the image pictured is of a RAV4 which is a different colour clearly, has a different roof profile with shaped metal running front to back down the roof, my own car is light blue with a mismatched blue roof and the photographed car was a dark blue one.

Anyway long and short I’ve received a letter today stating they have decided to oppose my application. The vehicles are COMPLETELY different - how is this possible?

They claim that they received no representation from me. Their line further down comments that sent the letters I did not receive first class and which has not been returned as undeliverable. Is it beyond their realm of fantasy to think that my appeal initially also wasn’t returned to me as undelivered?

They have sent this back to the TEC - it’s hugely unfair since supplied images show clearly that it is not my vehicle.

we need to see the documents firstly but if TEC reject your OOT then you can then apply to have that decision reviewed by a judge who given the circumstances is likely to allow it yhen you can start the appeal process

I'm researching at TV piece about this topic for BBC London TV and would be interested to know what happened to your case. If you can email me (there's an email icon you can click on that allows you to email me directly) I'd be keen to know how this ended as part of the issue is the difficulty that people have proving that it was infact a cloned vehicle.
