Islington parking no payment fine - received notice to owner

Hi,

I am new here.

I got PCN on 12th June for not paying for parking. Actually at the time my parking app had difficulty identify the location code, so I paid to a different location code.

I appealed immediately on their website on about 16 June. But after submission I didn't receive any email or post confirmation of my appeal. I called the council a few days after to check the appeal and they confirmed over phone that my appeal was recorded in system and I should wait.

Since then I am waiting for a decision. But now without receiving any appeal decision I received a Notice to Owner letter requesting me to pay full amount £110.

What should I do next? I know I can make representation but what do I say in it, and without appeal proof what is my chance?

Post the NTO, hiding only name and address.

Do you have a copy of your initial challenge.

Why didn't you read the location code on the parking sign.

Did you use the app to geo-locate you and from where.

NTO is attached. I read the code, but when I input the code to the app or input into phone call, it says the location couldn't be found. I made sure the input code is correct. So I used my last used code in the app system to pay for correct hours. I geo-located but also failed to find the location. But after a few days when I tried again that location code is back to OK and can be found. Probably tech glitch.

PCNs served as a paper document to car or driver have always been required to state, that reps can be submitted and will be considered, but that if an NtO is received despite this, the owner must respond to the PCN.  There isn't anything particularly unusual in people getting an NtO despit submitting informal reps against the PCN. Is it council incompetence ?  Maybe, but the regulations for paper PCN content have always insisted the above text or similar.ANy PCN without this warning can be considered void. Reason for all this is that the owner is usually the person who gets the PCN and submits reps, but on receipt of a PCN may think "I have already submitted reps" and not bother responding to the NtO, at which point it is Game Over.

It's hard to prove a system glitch without evidence such as screenshots.

What was the location you paid for and how long and how much. The contravention is not paying for parking but if you made an equivalent payment then you did pay, but Islington is a stickler for its location codes and sadly most adjudicators tend to side with councils on this assuming the location is specified in the traffic order.

You can also say you made informal reps but received no reply.

The decision will come for you if they reoffer the discount otherwise you have no incentive not to take it to the tribunal.
