Islington council PCN Grosvenor Avenue N5

HI,

I received a PCN whilst working for a customer on Grosvenor avenue in Islington. The customer had paid for my parking via the RingGo app and has sent me the receipt. The parking code is 62020 on the Ring Go receipt. 

I appealed it and sent the receipt for the parking, the parking code 62020 the customer had used comes back as Grosvenor Avenue - Zone Q when you put that into Ring Go

They have declined my appeal and said that only applies to certain bays on the street. I have never had a problem using RingGo to park and used it while I lived in Walthamstow to cover guests parking for the CPZ. But I guess that was for a whole zone rather than one bay number.

I’ve swallowed a few and paid them but I feel like this is utterly ridiculous as the parking code comes back as Zone Q of which the customer has covered and the PCN says I was parked in Zone Q without a ticket.

I have until the 28th to pay the lower amount, is there any room for appeal?

What do you guys need me to attach (if anything) as I have the original ticket, the appeal response & the parking receipt.

Islington has form on initially being unreasonable about these situations but can back down when pressed.

Your customer bought a pay session for a shared use pay/residents bay further along the road instead of buying a visitor's permit that would have been valid in the bay you were in.

But given £13 has been forked out for parking for 1 hour - probably a lot more than if it had been a visitor permit - not to cancel this I'd say is contrary to government fairness guidance for an honest mistake that did not disadvantage the council.

The problem is that the tribunal can't apply mitigation so to go on with this you'd be aiming to get Islington to cancel at formal stage.

Thanks for your considered reply. I am mindful to fight this and just pay the full amount if the tribunal make me. I think the risk vs reward is worth it. So just to be clear, I should make a full account of what happened to the council once they send out the next stage?

Who is the registered keeper of the van.

The case below has similarities but was stronger - but a key here is to involve your customer with a witness statement on what they thought they had bought you as RingGo can be confusing.

Essentially the case is around the fact that the resident the OP was visiting paid for parking in a bay where pay-by-phone was available, but should have paid for a visitor permit for the bay he was in which was residents only..

Yes, I was parked in the space where the red Prius is in that first link.

Yes that is essentially what has happened, is it worth an appeal or just pay the 65? I’m all for taking them all the way but no point really if it’s cut and dry. Cheers

If it were me I'd have a go under the confusion with using the app/parking bays, and also government fairness guidance given the £13 receipt and no doubt plenty of spare bays there on the day but it's a £65 punt. They are though very likely to reoffer the discount after rejecting at NTO stage.
