Islington Council PCN - Out of date or not?
« on: »
Hello,

Can I get some advice here, please? There are two CHarge notices i received from Islington.

So this PCN was issued last year. it was wrongly issued as i had a valid permit to use. I took the case to the adjudicator, and the court date for it was in May. I lost the case annoyingly as the Adjudicator did not understand that the council are incorrect to claim that the emergency permit I was using was 'not an emergency' even though I provided valid proof and legal wording for using the permit.
The amount on the Adjudicator's letter i received was £160. I did not receive any communication from the council requesting this amount and the first letter i received was this letter, which is now stating i owe £240. How is this possible?
What are my options as i would like to take this case to court since i was in fact, using a valid permit? I have since been using the same permit and nothing has happened, so i wonder what else i can do after an adjudicator's hearing.

I received this second letter the following day. This PCN is supposed to have been cancelled. The adjudicator only discussed the case above.
Therefore, is it not out of time for the council to request this charge?

Can you give us the adjudicator case reference and give us precise dates please. If the adjudication was in May, I wouldn't expect a charge certificate to be issued the same month.

No that's a different case (on Hornsey Road rather than Blckstock Road)

From that decision:

A Charge Certificate may have been issued in aspect of other Penalty Charge Notices as the Appellant sought to appeal others at this Tribunal before the Enforcement Authority had issued a Notice of Rejection in respect of them. Each case is dealt with on it own facts.

I have a feeling that this thread could get complex!

thank you for pointing this out. The hornsey road case ref, is the only case that went to an adjudicator. You are correct that it is not related.
Therefore These other two, must be out of time by now? and why did i receive this all of a sudden.

What are my options?

We need to know more.

Why do you say they are out of time? Can you give us dates of all the council documentation for each case and the dates you submitted your challenges?
