Islington Contravention Code 01 Caledonian Road

Hi everyone.

I got a PCN for parking during restricted hours on Caledonian Road. The PCN is below. The pictures only showed my car, and no street signage.

The closest gateway signs (if they're called that) has one of the signs missing on one side, I don't know if that helps. This is on Brewery Road.

I appealed simply saying "The contravention did not occur". I have included their response to the appeal below as well.

As usual any help is greatly appreciated. Thank you.

There is no legally mandated requiremnt for 2 signs, but there is an adequacy of signs requirement in Regulation 18 (1)(a) of The Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 : -

These Regulations prescribe the procedure to be followed by local authorities in England and Wales for making the main types of traffic and parking orders under the Road Traffic Regulation Act 1984...

However, you parked on a single-yellow line with no signs. Surely this should have alerted you that the location might be in a Controlled Parking Zone and you needed to check your parking ? . These CPZs are in place all over London.

I knew the parking timings. I left it overnight, and forgot to move it the next day. Normally I'd wake up and move it to a permit bay as it becomes available.

I was just seeing if I had any way of wriggling out of it.

None that I can see, although our Hippocrates may be able to suggest a 'technical' appeal that has nothing to do with the contravention itself.

I do. For IS-D which is on Brewery Road, adjacent to the road where the contravention occured.

A technical angle is what I'm searching for, to see if I can take it all the way to tribunal.

Your best bet was probably to ask for a first time cancellation as a resident permit holder and it was an oversight but they probably wouldn't have cancelled.

The tribunal does allow appeals where the CPZ signage and council evidence of such is poor so you could try playing dumb and continuing in this way but it would be a gamble and in any case you would first have to write reps to the NTO. You could just say the CPZ entry signage from your direction of travel was inadequate owing to a missing sign.

The signage shown in the council's response is 0.3miles. Which according to Google maps is a 6min walk, therefore 12mins there and back.

Owing to the 0 minute observation time. Someone traveling to and from that sign in order to check the timings, would have found themselves with a PCN anyway.

I appealed again along those grounds.

You got an NTO?

You don't 'appeal' to councils - you make representations. Appeals are to the tribunal.

I see you have history with multiple Islington PCNs, most successful and two others still outstanding.

While adjudicators may focus only on the evidence to hand Islington may well say you are well aware of local restrictions.
