I sent a reply to the NTO [I have a confirmation email from havering council of it's receipt but have now received a charge certificate with no reply to my NTO. The charge certificate has some errors [the date of contravention and date of NTO are the same and it's format just doesn't look right as it lists the reasons why the CC COULD be sent but not which it is. I'm a bit puzzled. Is it correct I can only wait for the charge to be lodged as a dept at the county court and put in my appeal for it to be reset to a new NTO to be issued ?

Date of NTO.

Date of your reps.

Were these submitted in the form and manner set out in the NTO?

The CC, could have been issued because you did not make reps in time and what you sent has been disregarded.

It's all about dates and actions, so pl post the above.

NTO was dated 05/01/2025 and Date of NTO appeal was 02/02. I used the online form the council supply that goes straight to their dept and an auto. confirmation email is then sent

Where is the Notice to Owner? The last one I saw was flawed.

NTO dated 5 Jan, therefore presumed served on 7th, 28-day period ends 3 Feb. If you made reps electronically on 2 Feb. then these were in time.

Next stage is to wait for the Order for Recovery at which point you make a submission that you made representations to the authority but did not receive a response. Send this as directed on the form, the CC and OfR will be cancelled and the matter referred to the adjudicator.

Keep the reps you submitted and the auto receipt, you're likely to need them.

Otherwise, it's a case of waiting for 2 weeks and then checking the council website periodically.

They have corrected the reps. date BUT NOT the payment date which MUST be 28 days from the date of service.

I'm not sure what you mean - could you explain please as it seams they claim on he CC that the NTO was sent on 25/10/2025 when the NTO date of service was 05/01/2026 and they ignored my NTO Rep.

You should follow the process. The NTO is flawed because it truncates the period of payment.

Oh you mean the NTO should state 28 days from the date of service rather than Not later than the last day of the period of 28 days beginning with the date of service of this notice I didn't know there was any difference.

OP, let's clarify.

You have been served with a CC therefore you have NO further representations to make to the authority: they are no longer judges in their own cause.

The contents and form of a CC are NOT prescribed, so forget about its errors because they cannot form the basis of a claim of 'procedural impropriety'. Any appeal is made to the adjudicator.

Your only concern now is to submit a Witness Statement to the Traffic Enforcement Centre in time. This would be enclosed with an Order for Recovery. So, after 14 days have elapsed from the CC keep your eye on your post and their website: when an Order for Recovery has been issued the total penalty increases by a further £10.
