H&F Council code 12 Parking without a permit

Hello,

I recently got a fine for parking on a street that had a residential parking permit scheme in operation.

Before driving to the road, I chceked the restrictions on the council's website. It stated that it was between 9am-5pm. I parked at around 7. I have photo evidence that their website was wrong.

The Council claim that it is actually in operation between 9am to 10pm. I challenged this saying that their website is misleading as it still had the 9am-5pm on their time.

I believe the council have contradicted themselves. In their challenge refused letter they mention that drivers have to check the signs and that no one should assume the previous system is in place.

In their Notice of Rejection letter they totally ignored my point that their website was out of date and then informed me that their website "clearly states that the restrictions are different in different parts of zone D"

I told them their website was wrong, they didn't update it for a couple of weeks. Now they have finally updated it and then state that their website supports their position. Of course it does, you just changed your website!

You should always check parking bay signs - how did you know what type of bay you were in?

Controlled zones actually only control single yellow lines but often parking bays are set at the same times, so presumably you went past a zone entry sign too.


That said the site misled you and I think they should have cancelled. An adjudicator may agree but this is not a certainty. The council may not contest too.

As the discount is on the table it's decision time.   

Their picture of the sign is poor and won't impress an adjudicator. Where was it in relation to where you parked?
