Hello,

Hope someone can help.
Received the below PCN from Hackney Council in my name. My wife was driving the vehicle at the time.
We are not from the area, although have visited in the past.
Seems they have installed a new timed pedestrian zone for the school on Castlewood Road.

She was unaware of the restriction, but would usually use Moundfield Road anyway (coming from Ravensdale Road). However, this being a narrow street and congested at the time she continued to Castlewood Road which runs parallel.

Can this be appealed with any of the below:

Moundfield Road was congested access, and in the confusion did not comprehend the signs at the entrance to Castlewood Road.

Not enough clear signage in the run up to the zone - not planning to visit the area again soon to get a video or photos.

New zone introduced since we have last been there during school term time.
Council PCN so bit trickier than private ones - "I was confused" or "didn't know" won't fly unfortunately.
Only real angle is dodgy signage. School streets need proper signs under TSRGD - if they're missing, hidden behind a tree, or wrong times shown, you've got something.

Can you get someone to check the actual signs? Or try Google Street View (might be outdated if it's new though).

If signage is fine, I'd just pay at the reduced rate tbh. Council tribunals don't really do mercy.

The signs in your GSV link for Castlewood Road are the usual 'Flying Motorbike' signs used by councils to bar motor traffic at certain times, and as a motorist, you are supposed to know what they mean. The GSV view is June 2022, so they have been there for over 3 and a 1/2 years, so not considered new now.

PCN is timed at 15.36, so well into the afternoon closed period, which is actually quite short, we normally see much longer times.

Don't just cough-up, but submit representations on the lines you have put here, with the emphasis on not being locals, but if you live somewhere else in London this won't be a strong point at all as these closed streets are all over London now.
Another point to make is that it is a left turn into Castlewood Road, and there is no advance sign to warn an approaching motorist, so put that in your reps and say that the restriction came as a complete surprise.

You may get luckly, but if not, they will re-offer the discount.

Thanks for your support, will try this.

This has been rejected.
The sign facing drivers along Ravensdale road is not very visible and the sign on entrance to Castlewood Road, does not face Ravensdale Road - sits a the corner.
Is this grounds to appeal?
@cp8759 @Hippocrates Are there any similarities to your recent post? https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/pcn-failing-to-comply-with-a-restriction-on-vehicles-entering-a-pedestrian-zone/msg111173/#msg111173

Thank you for writing to us.
We have carefully considered what you say but we have decided not to cancel your Penalty Charge Notice.
We sent you a Penalty Charge Notice because our CCTV camera evidence shows your vehicle entering a pedestrian
zone when it was not allowed to. There is a white, rectangular sign which says 'Pedestrian and Cycle zone' and shows the rules.
We have noted what you have stated however it remains the driver’s responsibility to be aware of signs and adhere to them. There is a sign facing drivers as they come along Ravensdale Road.

You can view a recording and still images of the contravention by going online. The footage may be viewed online at http://www.hackney.gov.uk/parking-fines. The dispute system requires Internet Explorer or Google Chrome to work correctly as other browsers may encounter problems.

The Council is committed to making Hackney’s roads safer and more accessible for everyone living, working and visiting the Borough. Encouraging the use of more sustainable modes of transport such as walking and cycling to school is one of the Council’s key transport priorities.

The School Streets scheme creates a pedestrian and cycle only zone in front of selected schools to most traffic Monday to Friday 8:30am – 9:30am and 3:00pm - 4:00pm. This is a safety measure to reduce the risk of accidents arising from inconsiderate parking and driving endangering other motorists, cyclists and pedestrians- especially children.
You have these choices:
You can pay the discount charge of £80.00. You have 14 days from the date of this letter being served (delivered) to do this.
You can pay £160.00 if you miss the discount period. You have 28 days from the date of this letter being served (delivered) to do this.

If you wish to appeal, please read the guidance notes attached to the appeal form enclosed with this letter. You can make your appeal online at the following address www.londontribunals.gov.uk. Please ensure that you quote the unique appeal verification code stated on this Notice of Rejection and follow the online instructions on how to complete your appeal. Alternatively, you can complete the Appeal Form enclosed with this letter (please read the guidance notes before completing it) and send your appeal to the Environment and Traffic Adjudicators (ETA) at the address stated on the form. Please do not send the appeal form to us. For any enquiries about your appeal, please visit the London Tribunals website at www.londontribunals.gov.uk. The adjudicator will consider your
appeal and make a final decision. Please note that an adjudicator can not allow an appeal on the basis of mitigating circumstances but may refer the case back to the authority for further consideration. An adjudicator can not normally award costs but may do so if he considers that either party has acted frivolously, vexatiously or wholly unreasonably. The directions of an Adjudicator must be complied with forthwith. If you do nothing
If, after 28 days, you have taken no action, we may send you a Charge Certificate increasing the charge from £160.00 to £240.00. You will then have 14 days to pay the increased charge. If, after the 14 days, you have not paid the increased charge, we may apply to the County Court to recover the money - plus court costs - from you.
