Hi everyone,

I have just received a PCN from London Borough of Harrow for being in a bus lane in NORTHOLT RD JCT ALEXANDRA AVE.

At the time of the incident I could only see that I was in a bus lane much too late and could not be avoided. As others mentioned before, this is a small stretch (just a bus’s lenght) of 24/7 enforced bus lane that comes after a very long bus lane that is enforced only until 7pm. I could see no clear indicators or markings and I personally believe is just a money trap.

The PCN does not give me a contravention code but rather a description of it. They left the vehicle make as UNKNOWN. And you can actually see that the BUS LANE marking is faded and also hard to spot.

Could you please let me know if there is any merit to me challenging this?

If so can anyone help with a formal challenge?

There is an advance sign, but it's buried in a destinations sign so in my view is not sufficient as most people know where they are going so have no need to look at this sign. It is typical sharp practice by councils.

HOwever, I can't see any bus lane immediately before this one so please post a link to it.

It appears to be somewhat of a 'hot-spot'.  Here's a successful appeal:

Reasons   
Mr Ben Nathan attended the appeal hearing today. He appeals against the Enforcement Notice issued for driving in the bus lane in Northolt Road junction with Alexandra Avenue on 11 August 2021 at 15.54.

The Enforcement Authority’s evidence they rely on is the CCTV recording and a number of library pictures (all undated). There is no site plan.

The first photograph is too blurred to make out what the white sign is indicating. The second sign, at the blue bus lane sign is on an island. The sign is placed in the centre front of the island. This appears to be behind where the bus lane starts. A photograph supplied by the Appellant shows the solid white line and the broken white lines which indicate the commencement of the bus lane much further back. The camera does not show the start of the bus lane.

There is no sign at the commencement of the bus lane which should be sited where the broken white lines commence and the sign to be used is 958. There is no evidence from the Enforcement Authority they have placed the correct sign at the commencement of the bus lane. The white sign they rely on is for information, it is not prescriptive nor does it show where the bus lane starts..

The bus lane is incorrectly signed. The sign is beyond where the restriction commences and there is no sign at that point. This issue has been raised on several occasions in cases coming before the Tribunal.

On the evidence I find there was no contravention. The authority have failed to prove the alleged contravention .

Harrow appear to be ignoring it and continuing to enforce the bus lane.

Yes, they just thumb their noses at the public and the adjudicators, because there is nothing to stop them.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
