Harrow Council PCN Bus Lane, Northolt Rd Jct Alexandra Ave
« on: »
Hi does anybody have experience of successfully challenging PCN from Harrow council Northolt Road / Alexandra avenue bus lane please?

PCN below link below

 Please advise if you need any other details. From Google this seems to catch a few people out due to short length of bus lane - and has been appealed successfully on occasion…

Obviously a genuine mistake

We've seen this one a couple of times on this forum, but I can't remember how it turned out. If you're prepared to take a gamble, there is a quirk in the Act under which the PCN was served that could result in a win at London Tribunals.

Have a look at Schedule 1 Admissibility of certain evidence(7)(6)

If they don't turn up, the video evidence is void. They have no other evidence.

Why would it be void if person has clearly gone into bus lane? Like why does them turning up make evidence any different?

Because the Act I quoted says so, and that is what Parliament has agreed.

@Incandescent!

I AM ABLE TO TAKE ON MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. I HATE RETIREMENT.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

Hi @Hippocrates apologies - so for my first appeal - what do I actually need to write please? I see you’ve shared links to previous case which went all the way to tribunal - but what before the I believe I need to make reps right?

Is there a template to follow? I don’t want to mess up first appeal and new to all this so appreciate all advice thank you :)

@Powertopeople12  If no initial challenge has been submitted (no worries there) wait for the Enforcement Notice.

I will take it on from that point. Meanwhile, check the grounds on their website.

Read it.  As per my advice above. I would not include a councillor. I'll advise later.

Too bad my petition to align the same caveat with all moving traffic laws in London did not get anywhere!
