I will submit the formal representation to the NTO
Also mention in your reps that by issuing the NtO, they have denied you the discount which is promised on the PCN for reps received within the discount period.

Hello,
I received an email that my formal challenge to the PCN has been rejected. About my question on why I my fine was increased to £110 from £55 even though I submitted the first challenge within 14 days they have said that it may be because of postal or other reasons.

Should I appeal to the independent adjudicator now ? Is there a way I can get this at least reduced to £55 ?
The email that I received is attached.

Please help.

If they don't budge on the discount, it is a no-brainer to take them to London Tribunals, and anyway, you were undertaking assisted boarding, an exemption to yellow lines. Don't let their arrogant letter put you off, you are in a winning situation.

Have you posted your original representations here ? You can use these but the adjudicator won't be interested in the loss of discount.

Dear London Borough of Harrow,

I challenge liability for PCN HR72522195 because the alleged contravention did not occur.

On this occasion I was picking up my son 5 year old son from a birthday venue called Puttstars, Harrow, (St Georges Shopping Centre, Harrow HA1 1AS). This shopping centre is adjacent to the the location where I stopped my car.

This venue is on the second floor so I had to wait for the lift and then go to the second floor, before returning with my son. All this would have taken about 15 minutes.

While I appreciate parking is not permitted at this location, there is an exemption for assisted boarding and alighting and a 5 year old child cannot be expected to make his way to the road on his own.

In light of the above the contravention did not occur and I invite you to cancel the PCN.

My only doubt is that the location is a shopping centre, and one presumes has parking facilities.  The adjudicator may look askance at parking where you did if there were parking facilities there that you could have used.  15 minutes is a long time for assisted boarding. You may be OK, but it doesn't look a slam-dunk win to me, but see what the others say.

Of course if they haven't re-offered the discount it is a no-brainer to take them to London Tribunals.

Hello,
I had submitted the case to the London tribunals. I got an email that my case will be heard on 6th Feb. I have not got any decision update yet. The online portal of the London tribunals asks for appeal verification code. (its mentioned that it should be on the notice of rejection letter) but I can not find any appeal verification code. How to check the status of the decision of my case ?

Having registered you would have access to the online portal giving you process A-Z. You should also have received the council's Evidence pack.

Your account has more gaps than substance. Also, the hearing was not determined on 6 Feb.

Don't tell me you asked for a decision on the papers?!?
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister.
