Merton Council implemented Experimental Road Closures in the Pincott Road area from 14th March 2025. The closures are non-physical but enforced using ANPR cameras. I was issued a PCN for an alleged contravention on 29th March 2025.

I am not local to the area but visit the area around once a week. As the road rule changes were introduced only recently, I was unaware of them and this resulted in a penalty.

Questions
  • For enforcement of moving traffic contraventions, shouldn't the council offer warning notices for the first six months or at least the first time?
  • Do I have any chance of fighting this?

Video shows you driving past a "Flying Motorbike" sign with no hesitation at all. Were you not aware of what this sign means ?

As this is such a new scheme, I suggest you submit representations on the lines of your narrative here, namely not local to the area, etc. Don't be confrontational, but suggest that some advance warning of the closure would have alerted you, and also it seems disproportionate to enforce the restriction that had been running for less than one month before you received the PCN, and that a warning would have sufficed.

Other aspect is that there may be a technical appeal argument based on Merton mismanagement of the enforcement process, so wait a bit but don't miss the deadline for submitting reps or paying which is 28 days from the date of the PCN. You are still within the 14 day discount period.

No. If there are any then it's up to you to bring them to their attention, assisted by us.

But on the basis of what we know, you contravened a restriction which was signed correctly and clearly. Reps within 14 days on the basis of terribly sorry, not been here for some time, new restriction which caught you out ..or however you want to word it..ask them to exercise discretion..is my suggestion.

Got some good news today! The council has cancelled my PCN and apologised, which I didn't expect at all. See attached letter
