Haringey Council Notice of Rejection.

Hello.

I have had an appeal rejected by Haringey Council for contravention 32D (Failing to proceed in the direction shown by a traffic sign).

At the end of Willoughby Road is a left turn only onto a congested street hence I did a U-turn to go around the perimeter of the park to get onto Westbury Avenue.

Any advice on what to do next? They've sent Adjudicator forms. Much appreciated. x

You are going to get zero sympathy from an adjudicator as you have told us you passed two blue one way up arrows and then did a u-turn because Turnpike Lane was busy, as it often is and got caught on your way back. Another expert may be more helpful than me but I suggest you pay at 50% whilst the going is good.

I help you pro bono (for free). I only ask that a donation is made to the North London Hospice if you can afford it and if you win. I have an 85% success rate across 2,000 PCNs but some PCNs can't be beaten and I will tell you if your case looks hopeless.

I actually did a delivery on Willoughby Road so would've needed to gain access but I guess that probably wouldn't stand in a tribunal as doing the delivery wouldn't have anything to do with the contravention committed, or maybe it could stand?

Blue signs give orders, to everyone, I think that not many police would drive against the flow due to the obvious dangers.

The pcn has been issued under the wrong Act and therefore has the wrong grounds for representation - an open goal Hippocrates - do you want to kick the ball?

So what is the correct Act, LLA & TfL Act 2003 ?

Other thing is that after turning round and running "wrong line" no arrow sign is seen as they are all for the other direction of traffic flow.

Yes, the correct act is the 2003 one. The PCN includes options for being at rest and for procedural impropriety neither of which apply.

I take the point that the council don't have any images of the van going the correct way to start with. It was an uninspiring piece of driving (and I speak as a member of the Institute of Advanced Motoring who hopes he wouldn't make such a mistake - I do make some) and I wasn't kindly disposed to this thread at the start but given the council blunder I'm less concerned.

This should be an easy win. Let's give Hippocrates 24 hours to step forward if he wishes (as my earlier message) and if he is too busy or doesn't fancy it (he mostly fights bus lanes) I will make the Appeal. My email is mrmustard@zoho.com

@Mr Mustard:  it is only accidental that I do bus lanes mostly - never used to, as you know! Did win a costs application v Kingston recently re a Yellow Box Junction though. I also enjoy driving down bus lanes on my bicycle (with trailer attached) dressed as Santa Claus with VRM: SANTA 007!* I will PM the OP with my details.

Thanks, got it.  Well, at least, they sent the correct appeal form pertaining to moving traffic contraventions.  This, of course, does not help their position.
