Hi all,

I'm assisting my father as his found himself in an unfair situation and requires assistance so I'm posting here as I have had luck fighting some cases here.

My father is a private hire driver and has been issued a ticket by a parking warden whilst picking up a customer the photos are taken two minutes apart with one photo clearly showing him reversing out.

The issue here is that he wasn't parked, he was picking up a customer as his a private hire driver in a private hire vehicle. Additionally, the parking warden hasn't placed any tickets on his windscreen (as he wasn't even there for that long, with some photos showing the blurryness of the attendant taking photos whilst walking up) There are 3 photos (One blurry photo from far, one closer photo showing him stationary, last photo showing his reverse lights on).

Fast forward to now, his received a Notice to Owner as we weren't aware of this ticket.

The service of an NtO without serving the PCN, is a major procedural impropriety which is normally a slam-dunk win at London Tribunals. There is a clear legal process defined in the Traffic Management Act to deal with so-called "driveaways". This process is for cases where the CEO was in course of preparing a PCN to serve to the car or driver, but the driver drove off before it could be served. The correct procedure is then to serve a postal PCN, which on it explains why the PCN has been served by post. No Notice to Owner is ever served under this process, because the postal PCN covers the role of the NtO.

You must first deal with the NtO by submitting reps stating that no PCN was served to the car or driver, by the CEO who you saw when driving away, therefore their service of an NtO is a procedural impropriety.
