Hackney, Parking Restriction, Balmes Road

Partial suspension of residents parking bay from 15th to 26th September (of which I have a permit), but my car was parked in a section that was not suspended which can clearly be seen in the photos taken by the enforcement officer.

First PCN was issued on 18th September which I appealed and was successful, PCN cancelled on 7th October.

During the time from the initial PCN being issued to the end of the restriction, I left the PCN attached to my windscreen to try to prevent additional tickets being issued. No additional tickets were placed on my windscreen.

However, in early November I received 3 emails from my Car Leasing company that they had paid 3 THREE additional PCN's at the full rate for the 24th, 25th & 26th September! Hackney Council state I cannot appeal as the PCN's have been paid and therefore closed, despite me being unaware and having irrefutable grounds that the PCN's were issued incorrectly.

Any recommendations on where to go from here?

What does your contract with the lease firm say about processing PCNs. The issue is that they are not your PCNs as the company is the keeper presumed owner.

No additional tickets were placed on my windscreen.

Did you check the car as windscreen PCNs would have been served on the car. Someone may have removed them. Are you sure the PCNs are for the same location? 

Do you have the PCN numbers?

The contract states the following:

"7.3 What happens if I receive a fine or penalty?

Parking, speeding and congestion charge fines are the driver’s responsibility, and we’ll
recharge them to you. Fines that fall into the sovereign category that have been issued by
the Crown (for example, Councils, toll roads, and non-private charges) cannot be transferred
and will be paid at the discounted rate."


The paid at the discounted rate part is interesting as that didn't happen, so may have grounds to claim 50% back from leasing company if no joy with the council

Yep, the car did not move and there was only ever one ticket on the front, so either the enforcement officer was removing the original each time they issued a new one, or someone else removed them

Notice to owners (NTOs) for windscreen PCNs are issued at the full penalty and the discount may only be recovered by making reps that are successful in that regard.

The photos for each PCN are still available.

I suggest you retrieve these and post here, specifically keep together those which purportedly show service of each PCN..

..then we can play 'Spot the Difference'!

These are the windscreen pics of the three PCNs in order. We can see some movement and possibly one under another but really only one in view.

PCNs do go missing though.

The key is whether we can get these refunded to the lease company or indirectly to the OP.

I expect admin fees were also charged?
