Author Topic: Lewisham PCN (53J) for driving into an allocated school street 10 seconds before the cut off.  (Read 53 times)

My wife went to collect our daughter from her school recently. It has been allocated a 'school street' and cars are not allowed in between 3 pm and 3.45 pm. She was recorded going into the street at 3.44.50s.

Our car clock was obviously out of sync with the council clock, and she should have left herself some wiggle room, but it is what it is.

I am 100% sure they won't let us off out of the kindness of their hearts, as it was only 10 seconds early, but is there any other way I can fight it? How do we know their clocks are accurate?

I would be grateful if the experts could review the PCN and advise whether I have a case.

You should submit representations on the basis that the clock in your car showed that the time was past 3.45, and you are somewhat astonished that the council see fit to serve a PCN timed 10 seconds before the end time, (3.44.50). You should point out that this is well within the legal definition of de minimis, and you expect the council to now cancel the PCN as it serves no traffic management purpose.

Wait a bit for other to comment or suggest a better text, but don't miss the deadline for payment or appeal on the PCN.

We have several cases to quote on triviality/clock accuracy and 10 seconds is trivial.

I'll dig out a case or two later. PCN is 8 June so no rush. 

I will add some technical points shortly.
