Author Topic: Haringey (Multiple) PCNs - Code 02(a) - Parked with restrictions in force - Endymion Road N4  (Read 301 times)

Hi, I have recently received two PCNs (one on Saturday 5th and one on Sunday 6th July) for allegedly parking in a restricted street while restrictions are in force. For context, there are a series of music festivals on in Finsbury park and they put these signs up on Endymion Road (N4, London) for the duration of the summer presumable to deter festival-goers from parking there (never had this issue in previous years). There is and has always been an exemption for resident permit holders (Green Lanes B for which this vehicle is covered). I've attached a photo of the signage which quite clearly states that such resident permit holders are exempt from the restriction. Note the car was not moved in between the two alleged contraventions.


The only section of the sign which has 'N/A' as exemptions is the 'no waiting/no loading at any time on the southeast side of Endymion Road'. Endymion Road curves around the north side of the park (street view link below) and there are no parking space at all on what could be perceived as either the South or East sides of the road - my vehicle is clearly parked on the North side of the road (outside ~no14) so I don't see how this would apply.


The notice for temporary parking restrictions even states that 'essential access for residents and frontages will be maintained as far as possible'. I managed to catch the enforcement officer on Saturday evening and he was adamant that even permit holders are not allowed to park here after 18:00 (despite the signage). I don't know if relevant but the two PCNs (so far...) both state 'temporary traffic officer' so perhaps he doesn't know how to interpret the sign...


Worth noting that almost every car on the street has been getting tickets this weekend. The restrictions also apply next weekend so I am unfortunately expecting to get further tickets (note there really is nowhere else to park unrestricted even if I wanted to). Any help to structure the challenge(s) much appreciated. Happy to share any other information that might help.

Thanks for digging that out, that's also what I took from the signage. Our vehicle has a virtual Green Lanes B permit, do you think it would it be as simple as sending that evidence in the challenge letter or is there particular phrasing that is important to include?

No special phrasing, just straightforward language.

I parked at ** where a traffic sign was displayed which gave the general effect of Temporary Traffic Order 85 from whose provisions 'Green Lanes B permit holders' were exempt. I was parked from *** on *** to *** on *** during which period the above PCNs were served.

I hold Green Lanes permit B, the CEO has clearly made a mistake and the PCNs must be cancelled.
