When I came to pick up the car, I asked for a form to fill out an appeal. At home I filled it out and sent it by mail with tracking, the letter was delivered in 2 days. I didn’t receive any answers!

I think it may help maks if they stopped expecting someone to walk up, smite the claimants down and leave maks untouched without maks engaging with the process. The people here are brilliant, some of the best in the business, and they are helping people for free. But it's help based on being given all the information available, not bits and pieces. The alternative is a bill over £1,000 which will happen if maks lets it.

I sent an appeal on this form. I wrote that I parked in a free parking lot where there are 2 posts without signs. I said that I have photo and video evidence, as well as many witnesses. But I didn’t receive any response!

Do you have a copy of the filled out form?

When does the Royal Mail tracking say your representation (challenge) form was delivered to the Council? It's not an appeal until the case gets to the Adjudicator.

You cannot appeal to the Independent Adjudicator until you get hold an appeal form. This might at least get the £265 PCN and tow before the Adjudicator.

I suggest you write a letter something like the below and post it to Newham. You'll have to fill in the blanks. See what comes back. Post your letter 1st class at the post office counter and obtain a free of charge "proof of posting". See what comes back.

Wait for others to comment or amend or improve my letter.

Dear Newham,

On the 16th October 2024 you removed my lawfully parked vehicle to your impound yard where I subsequently had to pay £265 to have the car released.

I completed the representation form that the yard provided and posted it. The Royal Mail tracking shows that this representation letter was delivered to you on 23/10/2024.

The Representation and Appeals Regulations provide that the Council had 56 days to serve a written notice on me either accepting or rejecting my representation. In the event of a rejection the Council further has to provide instructions as to how an appeal can be made to the Independent Adjudicator at the London Tribunals and the necessary form and verification code. To date there has been no response at all to my representation.

Since the Council has failed to serve a notice of acceptance or rejection within the 56 day period. The Council is now deemed to have accepted the representations and served a decision notice to that effect.

Please confirm that you have cancelled the PCN and refund the £265 paid.

If you do not cancel the PCN then please let me have the required form and verification code to submit an appeal ton the London Tribunals.

I look forward to prompt receipt of your refund.

I presume you mean the address to where you posted the representation form that you received from the impound yard?

You've told us you sent the completed form via tracked mail.

Once again, when does the the tracking say your letter was delivered? Print off a copy of the tracking from the Royal Mail website. And post up the tracking on here.

We can now see that the OP posted his representation to the Council's PO box 71575, postcode E6 9LY on the 21st Oct 2024. This is evidenced by the posting receipt. And that the letter was delivered on the 23rd October 2024 according to the Royal Mail tracking

So I suggest that the OP now sends the letter I posted earlier, unless anybody wants to revise or improve it.

The objective being to get an appeal form and verification code from the Council so that an appeal can be registered with the London Tribunals for PCN PN39936195 and the tow-away.
