Fishers Lane W4: Did U-Turn just as I realised the road
« on: »
I came off the roundabout from B409, as I was about to turn into Fisher's Lane I realised it was 'Access' only. I did a U-Turn around the yellow Island and avoided going down the road. Do I have a case here?

Letter:

Road

UTurn

Do I have enough grounds to fight this? If I didn't go down the road and did an immediate UTurn?

This should be in the council sub-forum. I've reported it to a mod.

Should I delete it and repost in Council?

So here: https://maps.app.goo.gl/ZaAjfT4sfVvou3FfA

The traffic order is The Ealing and Hounslow (Fishers Lane) (No. 1) Traffic Order 2022, I have requested the video as that is the key evidence.

It sounds like you might only have mitigation to put forward, but as long as you submit representations by 30 November the discount will be reoffered even if they reject, the video should only take a day or two to become available.

As a last resort we should be able to get a failure to consider in the notice of rejection, and we can appeal to the tribunal based on that.

Most of us work full time so you might have to wait a few days to get a response, but we always respond to every post.

Here's the video:

It doesn't show you completing the U-turn, so we might have to use a variation of the link strategy that worked in Simandeep Johal v London Borough of Lewisham (2230428653, 04 November 2023).

Is there any other meaningful mitigation, even if unrelated to the contravention, that you could mention in the representation? Don't make anything up, but if there is anything no matter how irrelevant please say so.

If not, I'll draft a representation for you over the next 2 or 3 days.

What the video doesn't show is that from either direction there are displayed regulatory 'no right/left turn' signs(as opposed to advisory signs), so arguably you committed either of 2 contraventions. But you can only deal with the one in the PCN.

All you have is mitigation at this stage IMO.
