It seems that Aberdeenshire Council is pursuing Excess Parking Notice except for pavement parking where Penalty Charge Notice would be applied.

However I cannot see any impartial appeal process apart from the Council's own appeal.

It seems they are not pursuing as a Criminal Case which they should refer to Procurator Fiscal. From the website it says if the payment has not been made and they would register as a debt and pass onto Sheriff Officer to enforce the payment.

I feel this does not comply with European Convention of Human Rights where everybody have a right to have fair and impartial trial.

Yes, it looks like a total Dog's Breakfast, but I'm not up to speed on Excess Charge Notices (ECNs), unfortunately, but a clue to the situation is that your ECN is for an off-road car park operated by the council. So parking on roads will be via a PCN. If  you look at the back of the PCN you'll see the enforcement and appeal process for a PCN and for an ECN. ECNs are restricted to offences within the car parks of the council

I found this off-street parking order on their website: -
