Sutton London, 34J: Being in a Bus Lane

Hi FTLA Team,

It was dark and rainy, I had to avoid oncoming traffic. The bus lane changes to two lanes right after which is why I am then on the left side of the road.

Can I get some advice on whether I have reasonable grounds for appeal. Thanks

Looks like you went too much into the lane by the bus stop but the lane does end just after there so this may be winnable on triviality.

There may be other challenges on website/cameras.

You were in the bus lane starting to enter just before the bus shelter. GSV measures this as 12.8 yards in the bus lane, but I would estimate only about 6.7 yards fully in the lane, which I would think is well within de minimis considerations, but councils, especially London councils, look upon trival contraventions like this as their bread and butter. So if you do want to fight it, you'd have to take them to London Tribunals.

Anyway, submit reps on the basis above, (de minimis), and post their response when you get it.

The oncoming traffic does make trying to stay further over to try and avoid a few metres of lane not that reasonable but the car behind manages it.

Note that London bus lane PCNs have a second enforcement notice stage from the council.

Sorry but do not admit to anything. Place the onus on Sutton to prove there were signs allegedly passed and that they have the necessary camera approval. Bus lane PCNs are straightforward as the law dictates they attend the Tribunal which many of them fail to do so the evidence is inadmissible. Post a draft first please.
