Enfield, Code 33C, Bus Lane, Bull Lane, London N18
« on: »
Hi, any advice would be most welcome.

The alleged offence happened on a Sunday evening, 3 August, at 6.40pm in north London
I was taking my son to a gig at  the Spurs stadium, I don't know the area at all and was looking for parking. I had no idea that I had done this until I received the PCN. Looking back, there was no prior warning that you were about to enter a bus lane but seems that there are no alternative options. Naturally when you look at the evidence you can see that there were signs and I'm sure locals might be aware of this but for out of towners! It's not that you could turn left/right or use a different lane. The only option is to completely turn around. Bull lane is a long, straight road for a bus land to suddenly appear seems a little sinister. Can argue also that just before 7pm on a Sunday night on a minor/irrelevant road!

I appreciate that I might not have any grounds other than human error and question the times that they monitor this road, you see many bus lanes that have flexible hours.

Any thoughts would be greatly appreciated.

TIA

We've seen this location before ! Council want to block it for through traffic. There is a red-backround non-traffic sign on turning in from Sterling Way (A406), but it is stupidly placed so one cannot read it before making the turn !

However, this is the latest GSV view of October 2024
HOwever, the restriction is some way down Bull Lane, past Bridport Road. On approach to the mini-roundabout at Bridport Road, there is an advance sign of the restriction ahead: -

then, at the cross roads a cul-de-sac sign: -

and finally the signs themselves: -

At this point, Bull Lane becomes Queen Street.

Going north on Queen St, this advance sign is present: -

then a bit further along a large red sign that doesn't really tell you much, plus the much smaller cul-de-sac sign. Obvioiusly with the enormous red sign, the cul-de-sac sign would be easily missed

The PCN says they may disregard any representations received more than 28 days from date of PCN.  Surely this has to be from date of service of PCN?

Yes, you're right. The LLA & TfL Act 2003 is badly drafted. Payment period is 28 days from date of notice and submission of reps period is 28 days from date of service. So if you submit your reps on day 28 of this period, you're overdue on paying the PCN ! A typical stupid drafting error on the Act that nobody spotted at the time.

I'm aware of that, but is the PCN not void in that case? It should state that representations may be disregarded if received more than 28 days from date of service?

Yes, because the period for submitting reps has been truncated by 2 days, this ought to win at adjudication as it is a major error; one that has caught out other councils too, I believe.

Thank you for your responses, greatly appreciated. So do you think on account of this major error I should lead my appeal with this? What's the best way to word it?

Many thanks
