Hi all,

Sadly received a PCN like quite a few others who have also posted on this forum regarding this most annoying junction    >:( . And like many My WAZE directed me to this junction at 16:12, it was dark and I'm unfamiliar driving in this area :'( .

So I have read that this particular junction is a hotspot for Barnet to cash in money: https://www.times-series.co.uk/news/15676382.barnet-council-earns-17m-at-tilling-road-junction-over-one-year/  >:(

I have read that some people suggested arguing that TILLING ROAD is a GLA boundary, belongs to TFL:

"the road in question is a GLA road by virtue of the GLA Roads (No.3) Designation Order 2008; and that therefore written consent of the GLA is required before the Council can enforce this contravention".

The Adjudicator therefore finds in favour of Mr Strom and cancels the PCN.

One person won:  https://drive.google.com/file/d/1UEoaFM5zlMcWqDcrYp6YeUap2EfkGeJC/view Strom VS lONDON BOROUGH OF BARNET

Another person UNSUCCESFUL APPEAL: https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/barnet-pcn-for-illegal-left-turn/

My question is: Do I have a case, if I appealed would I win, should I even bother challenging as it seems mixed results in winning    :-\

Any help/ advise appreciated,  :)
Thank you Amy

This is a council matter, not a criminal charge. Needs to be moved to the "Council" section.

@ying28 this can easily be dealt with if you've not paid the PCN.

There hasn't been an unsuccessful appeal, @sideadder just gave up half way through the process, but his case could have easily been won.

@ying28  draft representation:

Dear London Borough of Barnet,

The alleged contravention did not occur.

Yours faithfully.

Send this online via https://barnetocm.itsvc.co.uk/ and take a screenshot of the confirmation page.

The council will issue a Notice of Rejection but we've never lost a tribunal appeal at this location.

Also a lot of people on here who know the answer will be away on holiday or visiting relatives at this time of year. We all give our time free too !

The key issue is whether you're prepared to take the matter beyond the council to London Tribunals. The decisions cited on this thread are at London Tribunals, so the full PCN penalty was in play; are you prepared to do the same ? Reason I say this, is because >95% of representations to councils and also TfL are refused.

To win, you need to trust what cp8759 says, and take the matter to LT

Here is the junction with the "No Left Turn" signs.

We've seen this location before on the now-defunct Pepipoo web forum.
You cite an unsuccessful case, but that case never got to London Tribunals, the OP folded and coughed-up the re-offered discount amount. The council will never give way no matter what you say, as they know that most people, like the one you cite, cough-up, so they get their money. OK, it's only half the penalty, but they manage to dine out very well on them.

Just to note that it is a No Left Turn restriction, not right turn.
