I make representations that the alleged contravention did not occur.
The PCN was issued for contravention code 19s, which when summarised is parked in a shared use parking place with an invalid permit or invalid pay and display ticket, or after the expiry of paid for time.
This contravention only applies where a previously valid permit or pay and display ticket becomes invalid, or when a valid pay session expires.
Your CEO has issued the PCN in error, as there was no valid permit or ticket that became invalid or a pay session that expired.
In your rejection of my informal challenge you say the car was parked in a permit only bay, This is incorrect - it was in a shared use bay, as evidenced by your pictures and the ‘s’ suffix in the contravention code.
At the time of the alleged contravention, there was an active pay-by-phone session for Carlton Road from 08:08 to 09:30. The PCN was issued at 09:17 on Carlton Gardens, during the period of that active session.
So a pay session was in place and it appears a PCN could have been issued for it not being valid at any time in the bay in question.
But instead a contravention was selected that did not occur.
Of course, you can also consider my original challenge which pointed out there was a trivial location error in roads of similar name that resulted in no loss to the council, and which you have a statutory duty of fairness to so consider.
Nevertheless, the PCN was issued in your error and I look forward to your early confirmation of cancellation.
