Ealing - 34j Being in bus lane
« on: »
Hello

Ref : Ealing council issues a 34j "Being in a bus lane", The alleged contravention was recorded from a roadside camera

I entered  a "At all time" bus lane in order to park on a single yellow line on a weekday, at 19:04. The single yellow line section does have a restriction yellow sign (Picture attached) indication restrictions Mon-Fro 7:00 am to 7:00 pm. I therefore took that as an invitation to enter the bus lane in order to park after 7:00 pm.

There appears to be a contradiction introduced by the Ealing council. On one hand they indicate and invite drivers to park on the single yellow line after 19:00, however issue a penalty if you enter the bus lane to park the vehicle.

Can someone please advise if there are grounds to appeal?

Thanks

Can you post a GSV link, please. This is better than you just taking screen shots of it.

What does the video show? Sorry, no time to search at present.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

Well, sorry to say bad news, but the sign you say is in the bus lane is actually at the end of it : -

So this sign applies to whatever part of the yellow line there is from the end of the bus lane onwards. Yes, the yellow line starts back in the bus lane, but the bus lane restrictions trump whatever the parking sign says.
Back in February 2018 the bus lane was only part time: -

So in 2018, outside the bus lane days and hours, the parking sign applied. Today, with a 24x7 bus lane, parking is barred 24x7 in the bus lane.
Maybe the council should have removed the yellow line inside the bus lane as it causes confusion, but I don't think they are obliged to remove it. I may be wrong so see what others say.
