Drove into new Bus gate with new installed camera Enfeild N18
« on: »
Hi all

I had to pick up something twice in same week in this area i have never been before, i followed Google maps it took me into this Bus gate not noticing that its Busses only.
First time a drove there was 3rd Sep and second time was few days later the 7th Sep

I got my first letter in the post on the 15th sep (created on the 12th) with a big warning that it is a new camera and next time you will get a pcn
few days later i got a pcn that i drove on the 7th sep

With what reason is best to challenge it?

I thought of writing that i only got the warning a week after i actually drove in again

How should i write it??

Waiting to hear

This is an argument that has been used in the past and has succeeded sometimes at the adjudicators. Naturally, the councils that issue the PCNs never give way because they keep all the PCN money and have the attitude of "well if you're so dumb as to pass clear signs several times, you deserve to pay up"  Yes, really !!

So you need to caefully construct your representations to the council. You can't get to the adjudicators until the council have rejected your reps.  Bear in mind also, if you're short of dosh is that going to adjudication is a double-or-quits gamble, because the discount option is lost at adjudication, so if you lose, it's the full penalty to pay.

I don't presume to be so good at writing, as to write your reps for you. What I suggest is you prepare a draft and post it here before you submit it. We have had people who've driven past a sign for over a week, and the first they know they've committed a faux pas is the first PCN turns up a fortnight later !

is this good??

I am writing to formally challenge the Penalty Charge Notice (PCN) issued to me on 07-09-2023, relating to an alleged violation of the bus gate regulations at Bull Lane N18 Bus Gate, I would like to bring to your attention the circumstances surrounding this incident.
On the 3rd Sep ‘23, I was directed to navigate through the area in question by Google Maps, a trusted navigation service I have relied upon in my travels. Unfortunately, the navigation led me into the bus gate area without any prior warning or indication of its restrictions. This was my first encounter with this specific area, which had undergone recent changes to its layout.
It is important to note that I was unaware of the bus gate and its associated restrictions due to the unfamiliarity of the area and the lack of clear signage. On the 3rd Sep ‘23, I inadvertently entered the bus gate, which resulted in the issuance of a warning letter. However, I did not receive this warning letter until 15th Sep. , a full week after the initial incident occurred.
Furthermore, I would like to draw your attention to the fact that the PCN was issued for a subsequent incident that took place on 7th Sep ’23 , which was several days before I received the warning letter. As the warning letter explicitly stated that it was a new camera installation and provided a cautionary message for future compliance, it is reasonable to assume that I would have taken immediate action to avoid any further violations had I received it promptly.
I take road safety and adherence to traffic regulations seriously and am committed to abiding by all traffic laws. I genuinely had no intention of contravening any traffic regulations on the dates in question.
In light of the aforementioned circumstances, I respectfully request that you review my case and consider waiving the PCN issued on 7th Sep ‘23. I believe that the delay in receiving the warning letter, coupled with my commitment to complying with traffic regulations, justifies a reconsideration of this penalty.
I have enclosed copies of the warning letter and PCN for your reference, along with my contact information. I kindly request your prompt attention to this matter and look forward to receiving a favorable response.
Thank you for your understanding and consideration.
Sincerely,

Never mention satnavs, the council will throw that right in your face. Here is a slight revision:

Dear London Borough of Enfield,

I am writing to formally challenge the Penalty Charge Notice (PCN) issued to me on 07-09-2023, relating to an alleged violation of the bus gate regulations at Bull Lane N18 Bus Gate, I would like to bring to your attention the circumstances surrounding this incident.

Unfortunately I was unaware of the bus gate and its associated restrictions due to the unfamiliarity of the area. On the 3rd Sep 2023, I inadvertently entered the bus gate, which resulted in the issuance of a warning letter. However, I did not receive this warning letter until 15th September , a full week after the initial incident.

The PCN was issued for a subsequent incident that took place on 7th Sep 2023 , which was several days before I received the initial warning letter.

In light of the aforementioned circumstances, I respectfully request that you review my case and consider waiving the PCN issued on 7th Sep 2023.

Had I received the warning letter in a more timely manner, the incident of 7 September would never have occurred as I would have made sure to take a different route.

I attach a copy of the warning letter for your reference.

Yours faithfully,

You're not enclosing anything, you're attaching it because you're sending this via the council website (the last thing we want to do is risk paper documents being lost or delayed in the post). There is no point in attaching a copy of the PCN, they'll have that in front of them when they look at your case.

Keep a screenshot of the confirmation page.
