Author Topic: Downs Road bus gate, Hackney - code 52m failing to comply with a prohibition on motor vehicles  (Read 187 times)

Hello all

I received a PCN today from LB Hackney for accidentally driving through a bus gate. Scan is available to view here:

I was using the car to take our Christmas tree for recycling as Hackney no longer collect routinely from individual households - the drop-off point was in the park immediately adjacent to the bus gate. I hadn't driven this route before and spotted a helpful parking place just past the gate which probably distracted me from the signage.

Streetview link here - https://maps.app.goo.gl/k41skR5wbVKNfbcu7 - although not the road design has changed a bit since this was captured. Black planters have gone and the pavement has been extended to cover the white line hatching on LHS.

Not clear that I have any grounds for appealing the charge but would welcome any thoughts!

The photo on the PCN does not show you passing a sign for your direction, only ones for the opposite direction, so submit reps on this point. However wait for others to comment because there may be a 'technical' appeal argument totally unrelated to the alleged contravention. These technical appeals are based on council mismanagement of the enforcement process and often win at London Tribunals. Be aware that whatever you submit, no matter how valid, the council will reject them, because they know that if they do, >95% of people then fold and cough-up. If you are to fight PCNs like this, (assuming your case looks OK),  you must be prepared to stand your ground and ignore the attraction of the discount.

You're right that the PCN doesn't show a sign in the direction I'm driving, but I can confirm that the signs are the same on the other side.

You're right that the PCN doesn't show a sign in the direction I'm driving, but I can confirm that the signs are the same on the other side.
They may well be, but by making the point about their video not showing the sign that was passed, they must prove the sign is there to an adjudicator. This is not as straightforward as you might think, but of course, means you must be willing to take them to London Tribunals, and risk the full PCN penalty.

Seems odd (and incorrect?) that 'the amount outstanding is £80 now and will rise to £80 very soon.

What course of action would you recommend? Should I submit an appeal on the basis that the PCN does not show me passing signs facing in my direction, as Incandescent suggests?

Just bumping this again as I'm not sure what appraoch to take - grateful for any guidance on whether I should appeal given the screenshot of Hackney's payment page.

I still have a few days before the discount runs out so hoping to be able to make a decision on whether to appeal or not this weekend.

I just checked the payment page again - the text in the box at the bottom of the page has now changed to:

"The amount outstanding on the PCN is £80.00, and will increase to £160.00 on Tue, 10 Feb 2026. Please pay £80.00 now."

Date of notice on the PCN is 20 Jan, so the 10 Feb date for the discount seems off (although longer than the 14 days described on the PCN itself). Odd!
