Dartford - PCN Contravention 01 - Binnie Road

Hi all,

Wondering if someone can help with a PCN the Ms picked up last weekend from Dartford Borough Council. <br><br>

The contravention is "01 Parked in a restricted street during prescribed hours". Do the double yellow lines on the road apply to the middle area where the vehicle was parked?  <br><br>

Do we have any possibility of a successful appeal?  <br><br>

Yellow lines apply to the carriageway, footway and verge - the whole road - so unless this is a designated parking place it looks correctly served.

The car was parked on the central island set aside for pedestrians or whoever, but not cars.

Never seen this before.

Are you/your wife the registered keeper of the vehicle. I ask because I could not see any way that reps would succeed at this stage and therefore the next document - Notice to Owner, see the PCN - would be served on the RK, not the driver.

Thanks for the replies. It's definitely an odd place to park but actually very common for people to park there in this area, never seen a PCN issued for it until now.

Wife is the registered keeper of the vehicle.

IMO, there are procedural improprieties in the PCN.

1. The regs provide:
b)that if, before a notice to owner is served, representations against the penalty charge are received at such address as may be specified in the notice for the purpose those representations will be considered by the enforcement authority;

The PCN states:
'..penalty charge must be paid or your challenge received within 28 days...

B******s.

IMO, nothing else in the PCN amends this gross procedural impropriety. So there's one line for your reps.

No-one cares a toss about Dartford's policies in this matter - referred to often in the PCN- because they're not the Enforcement Authority, this is Kent CC.
So, I suggest you find out who at KCC administers this agency arrangement and find out KCC's policies as regards:
Challenges made outside the 28-day payment period;
Whether the discount may be re-offered in the case of unsuccessful challenges or formal representations against a NTO.
Do KCC have agency arrangements with other districts and boroughs in the county.
Send a copy of the PCN, less the particular details of time, contravention etc. and ask them to confirm that they have authorised this form of PCN to be issued in their name.

Or for £35 chalk it up to experience.
