Dagenham Code 62 PCN / Lawrence Cres

Hey,

Ive moved to Dagenham a few months ago and have always parked in the same area. I parked like all the other cars half on the pavement. I hadnt checked up on my car for couple of days and when i checked today I had 2 PCN's with the Code 62. My question is if this is fair as I was the only one who received PCN's. Ive checked with the owners of the other cars which are seen in the councils evidence and they have not received any PCN's. Do I have a chance to appeal this ?

Pleas also post the PCN. Do not redact anything if this is a kerbside PCN. Redact only name and address on postal PCNs and on other postal enforcement documents.

Dagenham are absolutely shite at this sort of thing because GSV shows cars parked part-off-carriageway in virtually all these type of streets; i.e. they have form !!

Unfortunately, the latest view of this street is 2020, and much can change in that time. There should be signs on both sides of the street to indicate whether off-carriageway parking is permitted and from where to where on the street. Are there such signs ? With GSV out-of-date, it is now your task to tell us if there are any signs indicating off-carriageway parking.  I had a quick look at other streets in this estate and there are NO such signs in 2020, yet cars parked part off-carriageway indicating it was tolerated then.

Hey,

I have now added up to date pictures on the Google Drive inc the CPZ Map of Dagenham. There are no signs stating anything other than the Lorry sign.

As I suspected, they "tolerate" off-carriageway parking and leave it up to CEOs to decide whether to serve a PCN or not depending on the car's position. I suggest you talk to a few neighbours to find out what is going on, and also contact the local councillors to ask the same question.

IMO, an adjudicator would disregard your claims regarding whether other cars park as you but without being penalised.

But what they can consider IMO is 'Ive moved to Dagenham a few months ago and have always parked in the same area'. This is your experience which could inform a defence of 'legitimate expectation'. But you'll need to put meat into this claim.

As the car hadn't moved the second PCN falls as it is a continuous contravention.

There are other possible issues. Before I look at the traffic order map post the reverse of the PCNs.

I have uploaded the Reverses on google drive aswell as a video I had with the CEO who issued the Tickets

I have also sent an email to my local councillor about this now.

They might interest themselves in the wider issue of footway parking in that area, but they cannot interfere in your case: you must make representations on your own behalf.

In short I can see:
You were parked in contravention of the London-wide 1974 prohibition of footway parking in a road subject to this restriction;
According to the OP, the car was stationary between 16th and 17th June
PCNs were issued by the same CEO at on 8.09 on 16 June and on 7.43 on 17 June, a gap of less than 24 hours;
Both PCNs are visible on 17th(which supports the contention that the car did not move between PCNs);
The second PCN has something attached between the envelope and the screen(OP, what was this?);

They've fixed missing info on the PCNs so we can forget that.

Barking is the borough with most confusion about footway parking and from Maps views in 2020/21 it was customary to have 2-wheel up parking on Lawrence Crescent and from the current CEO pics it still is.

There are no parking bays - it's unrestricted street other than one disabled bay that is marked as 2-wheel up!

There may well be a resolution in place disapplying the footway ban in the area.

Hey,

Ive challenged both PCN's and ive gotten a response back for both.

First Ticket - Rejected (Based it on the chat with the CEO and that there is no guidance and that i was following what my neighbours were doing,attached pictures)

Second Ticket - Rejected (Based it on that the Car didnt move on this ticket)

Do you guys think i should challenge it again or to take the Loss

THe next stage is the Notice to Owner, sent to the name and address on the V5C Registration Certificate. Are you the owner and if so,  are the V5C details up-to-date
