Hi everyone.
My brother got a ticket on south island place just off brixton road,  he parked his car in the red route box and when he came back to it he had a pcn on his windscreen. He was parked in there for maybe just over an hour and a half.
I sent an appeal to tfl with the usual template from cp, but of course, they sent a notice of rejection to my email address a few months later saying this.

So I waited for them to send the NTO and they finally sent it this month.

Is this normal the ammount of time this has been carrying on?

They have 6 months to serve the NtO from date of contravention.  However you could submit reps that serving it nearly 6 months since contravention date when the limit is 6 months is grossly unfair and tantamount to a procedural impropriety because no reason has been give for such late service.  The Statutory Guidance on parking states this: -

Issuing the notice to owner
If the penalty charge is not paid the enforcement authority may issue a notice to owner (NtO). The purpose of this is to ensure that the PCN was received by the vehicle owner and to remind the vehicle owner that the payment in full is now due and, if it is not paid within a further 28 days, it may be increased.

The NtO may be issued 28 days after serving the penalty charge, and we expect authorities to send them within 56 days. The ultimate time limit, in exceptional circumstances, is 6 months [footnote 33] from the ‘relevant date’. There should be a very good reason for waiting that long to serve an NtO. The regulations set out the information that the NtO must [footnote 34] give.

There are different requirements when the penalty charge notice acts as the NtO - see the section in this guidance on ‘Enforcement using approved devices’).

Authorities must [footnote 35] specify on the NtO (or the PCN when served by post) the statutory grounds on which representations may be made. Where a photograph or other camera evidence shows that the parking contravention took place, authorities should send this with the NtO as it should help to prevent unfounded representations.

Where a penalty charge is served on a vehicle with a diplomatic registration plate, but no payment is received within 28 days, an enforcement authority should not issue an NtO but keep a record of the unpaid penalty charge.

Every year the Foreign and Commonwealth Office will request details of all unpaid penalty charge notices and then seek payment from the relevant contraveners.

I also think that i can send cp's appeal template to this NTO again if i remember correctly.

Really sorry to bump this.

I have to send the appeal tomorrow now via post as the TFL website won't let me challenge the pcn online. Unfortunately I can't find the appeal template from CP as I had it on peppipoo but that website is now down.
Does anyone please have the template as I need to send this off tomorrow?

@Torenaga I'm not sure what template you're referring to, the fact of that matter is TFL will send a notice of rejection no matter what you say. You've also left this quite late, so you'll have to send the letter by special delivery (if you send it first class and it doesn't get there in time for the deadline, your brother could end up owing £240 and have no right of appeal).

Here's a basic draft:

Dear Transport for London,

I challenge liability on the basis that the alleged contravention did not occur.

Furthermore, I contend that the inordinate delay in serving the notice of rejection shows that the authority has failed to have regard to the statutory guidance which provides that "The NtO may be issued 28 days after serving the penalty charge, and we expect authorities to send them within 56 days. The ultimate time limit, in exceptional circumstances, is 6 months from the ‘relevant date’. There should be a very good reason for waiting that long to serve an NtO".

In failing to take this guidance into account, the authority has failed to comply with the requirement imposed by section 87(2) of the Traffic Management Act 2004, and that is a procedural impropriety.

It follows that the penalty charge notice must be cancelled.

Thank you for the reply CP.
The template was in regard to the usual red route appeal we used to send off.
I know I left this late, I was meant to do it 2 weeks ago but unfortunately a death in the family threw it off. I will get it sent off via special delivery tomorrow. It should just make it in time hopefully and I will get it signed by my brother. 👍
