TFL - Stopped where prohibited (on a red route or clearway)
« on: »
Hope everyone is well,

I have received this PCN while being parked on a single red line at 23:54 which was enforceable at 7AM-7PM. From the pictures it does look as if the rear end of my vehicle may have been over where the single red line ends but my wheels was most definitely on the single red line.

Draft :

I am writing to formally challenge the above-referenced Penalty Charge Notice issued to my vehicle. The alleged contravention is "Stopped where prohibited (on a red route or clearway)," but I believe this charge has been issued incorrectly.

My vehicle was parked on a single red line on Edgeware Road after the restricted hours of 7 a.m. to 7 p.m. As I understand, parking is allowed outside of these hours, and my vehicle was parked well after this time, making the penalty unwarranted.

I kindly request that you review this case in light of the following points:

Time of Parking: My vehicle was parked after the restriction period (7 a.m. - 7 p.m.) had ended, and therefore, no contravention occurred.

Signage and Clear Indication: The signage at the location clearly states that parking restrictions are only in place between 7 a.m. and 7 p.m., which I adhered to.

I have attached evidence to support my appeal, including photographs of the signage and my vehicle parked after the restricted hours, along with any relevant documents.

I trust that this information is sufficient to have the PCN canceled. Should you require further clarification, I would be happy to provide additional details.

Thank you for taking the time to review my appeal, and I look forward to your favorable response.

---

I also remember on a previous thread being told that TFL have numerous errors within there PCN at the moment, will this be the case here?

Thank you.

Sorry, but it's where the whole car was than counts, so if part of your car was intruding into the double-reds, you'll get a PCN. So we really need to see the TfL photos or video. It should be a video, and you can ask for a DVD to be sent to you, then you can upload it here for us to look at.

I had asked for the DVD footage of this PCN. It doesn't show on the PCN key events and today I have received a PCN increase letter instead.

I will call them tomorrow

Here is the charge certificate - https://ibb.co/7yWV59g

Just got off the phone from TFL speaking to the most insane representee 'Michelle' on the phone. Asking me why you appealing it you can clearly see it parked on a double red and someone's leaning on it. Raising her voice and very unprofessional.

She said the DVD has been requested but she can't tell me why it hasn't been sent. She also claimed the charge certificate hasn't even been sent yet.

The key events do not show any DVD requests either.

I need to put a representation ASAP, any recommendations on what to do?

Just submit a very short reps stating that you deny responsibility for the PCN on the basis the alleged contravention did not occur. Also state that you have requested the TfL video of the allegation some time ago, but this has still not arrived.

@privates and the rest of the CC?

@Incandescent This appears to be a charge certificate? Have they sent it prematurely?

And that is all of the CC I can find for the time being

I will put through the appeal now

PCN issued 14 Oct. giving you until 12 Nov. to submit reps after which date any reps could be disregarded by TfL. Even more so now that a CC has been served.

But you can but try.
